SC refuses to stay trial court proceedings against Nithyananda

The Supreme Court on Wednesday refused to stay the trial court proceedings against Swami Nithyananda in a six-year-old rape case.

 

 

A bench comprising Justices Dipak Misra and A M Khanwilkar did not suspend the trial court proceedings in view of a pending challenge to a high court order that had directed handing over certain documents, including “unauthenticated medical records” of the rape victim, to Nithyananda. In an earlier order on 7th November, the Court had directed the Trial Court to proceed with hearing the arguments on charge.

Nithyananda’s counsel opposed the Special Leave Petition filed by complainant Lenin, questioning the locus standi of the petitioner in the criminal case. Lenin, who acted as driver of Nithyananda, had filed a complaint with the police in 2010.

Meanwhile, advocate V N Raghupathy, appearing for Karnataka, submitted that the state has also filed a special leave petition against the July 21 order of the high court. The apex court, while refraining from passing any further order, put the matter for consideration on January 17.

In its petition, the state government contended that the high court ordered for providing statements of 32 witnesses, including that of actor Ranjitha Menon to the accused. 

Ranjitha’s purported CD with Nithyananda had led to registration of criminal cases. The high court had also directed furnishing medical records of another victim and her email conversations to the accused.

The state government claimed the documents were not part of the charge sheet filed against Nithyananda and others in the rape and cheating case registered in March 2010 in the Bidadi police station in Ramanagaram district and, had not been relied upon by the prosecution.

Nithyananda and four other accused are seeking the “records virtually to set up a defence at the pre-trial stage which cannot be permitted”, advocate Joseph Aristotle, representing the state government submitted. He said the accused had misused the judicial process in order to delay the proceedings.

Nithyananda, who was booked for rape and indulging in unnatural sex, was arrested on April 22, 2010. Later, he was granted bail on June 11, 2010.

The 39-year-old, who founded an ashram with its headquarters on the outskirts of Bengaluru, was directed by the apex court in 2014 to undergo potency test and give blood and voice sample required for investigation of the case.

 பெங்களூரில் உள்ள 'சமயா’ என்ற லோக்கல் சேனலில் ஹரித்துவாருக்கு யாத்திரை சென்ற சிலரது பேட்டி ஒளிபரப்பானது. அந்தப் பேட்டியில், ''யோகா மற்றும் தியானப் பயிற்சி முகாம் நடத்துவதற்காக ஹரித்துவாரில் உள்ள சரோவர் ஹோட்டலில் நித்தி யானந்தாவும் அவரது சிஷ்யர்களும் தங்கியிருக்கிறார்கள். ஹரித்துவாருக்கு டூரிஸ்ட்களாக சென்ற நாங்கள் சரோவர் ஹோட்டல் மேனேஜர் பிரிஜேஷ் குமாரிடம் ரூம் கேட்டோம். இதைக் கவனித்த நித்தியானந்தா, 'கன்னடர்களை இங்கே தங்க அனுமதிக்கக் கூடாது’ என்று சொன்னார். அவர் சொன்னதால் எங்களுக்கு ரூம் கொடுக்கவில்லை'' என்று சொன்னார்கள்.

'இனி, நித்தியானந்தா கர்நாடகாவுக்குள் வரக்கூடாது’ என்று ஆர்ப்பாட்டம் நடத்தினர். போராட்டத்துக்குத் தலைமையேற்று நடத்திய கர்நாடக ஜனப்ரா வேதிகா அமைப்பின் ஒருங்கிணைப்பாளர் ரமேஷ் கவுடா, ''எங்களுக்கும் நித்தியானந்தாவுக்கும் தனிப்பட்ட விரோதம் கிடையாது. அவர்மீது பல்வேறு குற்றச்சாட்டுக்கள் இன்னும் நிலுவையில் இருக்கின்றன. தன்னை கடவுள் என்றும், சிவன் என்றும் நித்தியானந்தா சொல்லிவருவது இந்து மதத்துக்கே பெருத்த அவமானம். இப்படிப்பட்டவர் ஹரித்துவாரில் உள்ள ஹோட்டலில் கன்னடர்களுக்கு ரூம் கொடுக்கக் கூடாது என்று சொல்லியிருக்கிறார். அவருக்கு வாழ்க்கைக் கொடுத்தது கர்நாடகா. அவரது ஆசிரமம் இருப்பது கர்நாடகா. இப்படி கர்நாடகாவை நம்பிப் பிழைக்கும் நித்தியானந்தா கர்நாடக மக்களையே கேவலப்படுத்தி இருக்கிறார். இனி நித்தியானந்தா எப்படி கர்நாடக மண்ணில் கால் வைக்கிறார் என்பதை நாங்களும் பார்க்கிறோம். நாங்கள் தமிழ் மக்களுக்கு எதிரானவர்கள் அல்ல. சாமியார் என்ற போர்வையில் கர்நாடக மக்களை ஏமாற்றுபவர்களைப் பார்த்துக்கொண்டு அமைதியாக இருக்க மாட்டோம்'' என்று கொந்தளித்தார்.

''நான் இந்த கர்நாடக தேசத்தை நேசிக்கிறேன். கன்னட மக்களையும் நேசிக்கிறேன். நானோ அல்லது என்னுடைய பிரதிநிதி எவருமோ கன்னட மக்களை ஹோட்டலில் தங்க அனுமதிக்க வேண்டாம் என்று ஹோட்டல் நிர்வாகத்திடம் சொல்லவில்லை. நாங்கள் மதத்தின் அடிப்படையிலோ, மொழியின் அடிப்படையிலோ எந்தவித தடைகளையும் ஏற்படுத்துவது இல்லை. நாங்கள் மொத்த மனித குலத்துக்கும் எங்கள் கதவுகளைத் திறந்து வைத்திருக்கிறோம். ஒவ்வொருவரையும் வரவேற்கிறோம். எதையோ என்னிடம் எதிர்பார்த்து சிலர் திட்டமிட்டு என்மீது பொய்யான புகார்களைப் பரப்பிவருகின்றனர். அவர்கள் மீது சட்டப்படி நடவடிக்கை எடுக்க எல்லா முயற்சிகளையும் செய்துவருகிறோம்'' என்று குறிப்பிட்டுள்ளார்.

Nithyananda re-arrested, sent to one-day judicial custody l

Just hours after being granted bail by a court in Ramanagar, controversial self-styled godman Nithyananda was re-arrested on Thursday and remanded to one-day judicial custody on charges of disturbing the peace.

Nithyananda, arrested on Wednesday after he appeared before a court to surrender in an assault case, was slapped with a fresh case of disturbing the peace in Ramanagara and surrounding areas of Nithyananda Ashram at Bidadi near Ramanagar.

He was arrested under different IPC Sections, including 151 (relating to disturbance of the public peace) and sent to one-day judicial custody, Ramanagara Superintendent of Police Anupam Agarwal said.

Agarwal said Nithyananda would be taken to Mysore Central Prison to avoid any untoward incidents and added that the case would be heard tomorrow and the Deputy Commissioner would take a further decision in the matter.

"Nithyananda has been exempted from personally attending the court. However, his lawyer will appear for him tomorrow," Agarwal said.

Earlier in the day, Ramanagara Judicial First Class Magistrate Komala granted bail to Nithyananda subject to him furnishing one surety and a personal bond of Rs.50,000.

Public Prosecutor K Mohan Kumar said bail had been granted to Nithyananda since assault and life threat case against him were bailable.

The self-styled godman, already facing criminal charges, including rape and out on bail after his arrest in 2010, courted fresh trouble when police on June 8 booked him and his followers for allegedly assaulting a mediaperson at a press conference at his ashram at nearby Bidadi.

Even as he faced the police action, Nithyananda filed a writ petition in the High Court seeking Rs.10 crore as damages to his ashram property from the state government.

Chief Minister D V Sadananda, Ramanagar District Deputy Commissioner and others have been named in the petition.

'Sex Swami' Nithyananda arrested in Himachal Solan, Himachal Pradesh: Bangalore's "Sex Swami" Nityanand has been arrested a long way from home - in Himachal Pradesh's Solan district. Nityanand was arrested in Arki by the Bangalore Police, who had sought the help of the Himachal Police. The self-styled swami would be produced before a local magistrate in Himachal Pradesh and then would be taken to Bangalore. The controversial swami has been at large ever since television channels aired video clippings purportedly of him and a Tamil actress in a compromising situation. His ashram had been searched and hard disks seized were being examined, the police said. On allegations of rape against the swami, they appealed to victims to come out and give evidence. The swami's ashram has maintained that there is a "conspiracy" to malign Nityananda's reputation and have said that the video footage telecast by TV channels was morphed. After the sex tape surfaced, Nityananda's supporters issued this statement: "At this moment we feel that a mix of conspiracy, graphics and rumour are at play in these recent events that have unfolded. We are working on a legal course of action...In these trying times, we wish to reassure the lakhs of devotees and well-wishers whose sentiments have been deeply hurt by this conspiracy. We thank all the devotees and disciples for standing with us during these trying times." Nityananda had recently announced that he was quitting as the head of his ashram in Karnataka and associated trusts to lead a life of 'spiritual seclusion'. Nithyananda's Ashram is about 19 kilometres outside Bangalore, where he was based and was attacked by an angry crowd. Condoms, drugs and secret contracts... the story of why Nithyananda is in trouble

Controversial self-styled godman Nithyananda Paramahamsa, who went missing for five days after fresh charges of rape and confinement were levelled against him, was sent to jail for a day by a local court in Ramanagara, about 30 km from Bangalore on Wednesday.

The tainted guru, who had gone into hiding, prompting the Karnataka police to launch a massive manhunt to trace him, surrendered before the Ramanagara district court judge on Wednesday afternoon. Judge Komala remanded him to judicial custody for a day directing him to appear before the court on Thursday to hear his bail plea.

On Tuesday, the police evicted the occupants of Nithyananda's ashram in Bidari on Bangalore's outskirts and searched the premises. They were horrified to find a dump of condoms and ganja in the corner of a compound. The police sealed the ashram for further investigation.

A team of the police had gone to Madurai in Tamil Nadu to search for Nithyananda as he was recently anointed as the 293rd pontiff of the Adheenam Mutt.

On Tuesday, Karnataka Chief Minister D V Sadananda Gowda ordered the arrest of Nithyananda after several of his followers appeared on a private Kannada TV channel and accused the godman of exploiting them.

Arathi Rao, a follower of Nithyananda, gave a detailed account of her five-year experience with the guru. She alleged that Nithyananda repeatedly raped her and threatened her with dire consequences if she revealed it to anybody. Arathi also claimed that it was she who had secretly filmed Nithyananda's sex tapes with a Tamil actress.

Though Arathi had not lodged any formal complaint with the police fearing repercussions, it was sufficient for the government to order a probe against Nithyananda. Initially, his followers tried to bravely defend Nithyananda by accusing Arathi of carrying out a slanderous campaign against their guru.

Things went out of control when the followers of Nithyananda evicted the journalist of the Kannada TV channel, which aired Arathi Rao's interview, from the ashrama and allegedly beat him up.

The attack on the media prompted several Kannada organisations to vandalise Nithyananda's ashram. The police registered an FIR against Nithyananda and his followers on the basis of a complaint lodged by the media.

Nithyananda had approached the high court seeking to quash the FIR filed against him. The court has adjourned hearing into the matter to Friday.

This is the second time that Nithyananda had gone into hiding. After the sex tapes went public in April last year, Nithyananda had moved into a secret location in Himachal Pradesh from where he was apprehended. At present, the Karnataka police CID is probing the old cases against Nithyananda.

Last year, public mounted pressure on the government after it was revealed that Nithyananda had forced some of his followers to sign a non-disclosure agreement to experiment with tantric sex.

"The volunteer understands that the programme may involve the learning and practice of ancient tantric secrets associated with male and female ecstasy, including the use of sexual energy for increased intimacy/spiritual connection, pleasure, harmony and freedom," said one of the clauses in the agreement.

This created furore as it was alleged that the guru was exploiting women by making them sign the contract. The CID is probing those charges as well.

Solan/Bangalore: Controversial self-styled godman Nithyananda Swami, who was absconding for over a month in the wake of an alleged sex scandal, was on Wednesday arrested in Solan in Himachal Pradesh.

Nithyananda and four of his associates were arrested from a house in Mamlig village under Akri police station area in Solan District in a joint operation by policemen from Bangalore and Himachal Pradesh, Deputy Commissioner, Solan, Amar Singh Rathore said.

He said Nithyananda, who is believed to have been living in the Solan village for the last one month, and his associates have been taken to Arki police station.

Nithyananda was arrested on Wednesday in a joint operation of the Karnataka and Himachal Pradesh police force.

Bangalore Criminal Investigation Department, investigating cases filed against Nithyananda, said it had recently seized some documents and articles during a raid on his ashram at Bidadi, about 35 km from Solan.

During the raid by a 15-member CID team, some documents pertaining to the ashram, computers and its hardware had been taken away by police, which had also questioned several ashramites, including Nithyananda's brother Nityeshwara.

Police were on the look out for Nithyananda who had allegedly indulged in sleazy activities and a purported video footage, aired by regional TV channels, had showed him in a compromising position with a Tamil actress.

Tamil Nadu police had registered cases against Nithyananda for various offences under IPC including rape. The cases are under investigation by Karnataka police, to whom they were transferred to.

Nithyananda had announced that he had quit as the head of his ashram in Karnataka and associated trusts to lead a life of 'spiritual seclusion'.

Swami Nityananda arrested in Solan

SHIMLA/BANGALORE: Controversial self-claimed godman Swami Nityananda, on the run since his sex romps were caught on tape and aired by TV channels, was finally arrested from a house in Solan district of Himachal Pradesh on Wednesday afternoon. Police recovered $7,000, Rs 3 lakh, three laptops, eight mobile phones, three video cameras from the house where Nityananda was staying since March 27.

The house belonged to Satinder Singh from Delhi, who, the police said, would be questioned soon. Nityananda was later driven down to Shimla and questioned there. Dressed in flowing robe but sans his trademark tilak, he looked calm. He would be produced in a Himachal court for transit remand and then taken to Bangalore on Thursday afternoon.

A joint team of Karnataka and Himachal Pradesh police tracked his cellphone calls for two days and surrounded the house in the isolated Shivshankargarh area in Solan. The police team from Bangalore, headed by two DSPs, had reached Solan on April 19. Cops took the help of a CID team from Shimla, before swooping down on

the house.

Assistant superintendent of police, Solan, Ramesh Pathania, said the swami was wanted by Kanataka police in two cases under Sections 295A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 376 (punishment for rape), 377 (unnatural sex), 420 (cheating and dishonestly inducing delivery of property), 506 (criminal intimidation) and 120B (criminal conspiracy) of IPC.

After the tapes of Nityananda with a Tamil actress were aired on TV on March 3, the godman's former driver Kuruppan Lenin filed a complaint with the Chennai police commissioner, while another case was registered at Coimbatore by Vishwanath for hurting the religious sentiments of Hindus. Bidadi police registered the cases based on the two complaints. The cases were handed to the CID, after which the CID sleuths started getting complaints from overseas through e-mail.

A court in Sriperumbudur in Tamil Nadu had issued a non-bailable warrant against him on Monday with the direction to produce him before the court on May 20, police said. His four aides have been identified by cops as Gopal Salem Reddy, Mithya Bhakta Nanda, Arun Raj and Arpil Sangil. The swami would be interrogated before a transit custody is obtained in order to hand him over to Karnataka police for investigation, said Himachal DGP Daljit Manhas. In Bangalore, CID DG Dr D V Guruprasad said a CID team conducted a search on the ashram on Tuesday and seized important documents, including hard disks.

Nityananda's lawyers said they were ready for a legal battle. A legal team is will move court in Bangalore on Thursday. Nityananda has rejected sex scandal allegations against him.

He resigned in March as the head of 'Dhyanapeetham', which he had founded near Bidadi on the outskirts of Bangalore.

 Solan/Bangalore: Over a month after he was reported absconding following his alleged involvement in a sex scandal, self-styled godman Nityananda Swami, along with four of his associates, was today arrested from the house of a Delhi-based businessman in Solan in Himachal Pradesh. 

The arrests were made by a Karnataka Crime Investigation Department team and policemen from Himachal Pradesh in Mamlig village under Arki police station area in Solan district, Deputy Commissioner, Solan, Amar Singh Rathore, said. 

32-year-old Nityananda and his associates, including his close aide, Nitya Bhaktananda alias Gopal Seelam Reddy, were being shifted to Shimla, 45 kms from Arki, for being produced before a court tomorrow for transit remand to take them to Bangalore, DIG in Himachal Pradesh CID, N Venugopal, said. 

They were arrested after the authorities tracked a mobile phone having a Himachal Pradesh sim card to establish their location, Superintendent of Police, Solan, Prem Kumar Thakur, said. Police did not disclose the name of the Delhi-based businessman. 

Others arrested were identified as Mitha Sanathan Nanda, Arpil Sangil and Arun Raj, Thakur said, adding that Rs three lakhs in cash, about 7000 US dollars, three video cameras and three laptops were found in the house. 

Karnataka Corps of Detectives DGP D V Guruprasad told PTI in Bangalore that two deputy superintendents of police had reached Solan on April 17 following information that Nityananda could be living there. There were reports that he had attended the Kumbh Mela in Haridwar. 

The controversial self-styled godman had gone into hiding after a purported video footage showing him in a compromising position with a Tamil actress was aired on local TV channels on March two. 

Nityananda along with others is wanted in connection with two cases registered at Bidadi, about 35 kms from Bangalore. 

Guruprasad said the CID yesterday had conducted searches in Nityananda's ashram and seized some 'important' documents and a computer hard disc. 

Nityananda has rejected sex scandal allegations against him. He had resigned last month as the head of 'Dhyanapeetam', which he had founded near Bidadi on the outskirts of Bangalore city. 

He had announced that he would lead a 'life of spiritual seclusion' for an indefinite period. 

The Tamil Nadu police had registered various cases under the IPC against him including that of rape. The cases were later transferred to the Karnataka police. 

The Ramanagaram police, under whose jurisdiction his ashram near Bangalore falls, have registered two cases against Nityananda. 

The Karnataka High Court had last month rejected Nityananda's anticipatory bail application. A petition filed by him praying for quashing of cases filed against him will come up for hearing before the High Court on Friday. 

Later, the self-styled godman and four of his associates were brought to the head office of CID at Shimla from Arki where they were briefly interrogated by a joint team of Himachal and Karnataka Police. 

Nityananda said that he had come to the state from Haridwar and was staying at the house in Mamlig under Arki police station, according to Additional Director General of Police (CID) I D Bhandari. 

The ADG alleged Nityananda was living in the house of a Delhi-based businessman which was taken on rent in the name of one Vikas Dogra. 

Deputy Inspector General of Police (CID) N Venugopal said the godman and four of his associates were in CID custody and most likely would be produced before a Shimla court tomorrow for transit remand to take them to Bangalore. 

When mediapersons sought reaction from the godman, he merely smiled and greeted them with folded hands without uttering anything.
