Rape case against Nithyananda: Trial finally begins after 8 years of legal hurdles

Eight long years after self-styled godman Nithyananda was booked in 2010 for allegedly raping his former disciple, an in-camera trial proceeding finally began on Wednesday after many legal twists and turns.

Informed sources told TNM that witness statements were recorded by the Third Additional District and Session Court Judge in Ramanagara throughout Wednesday, after framing of charges was done in June at the insistence of the apex court. The recording of witness statements will continue on August 16.

Other than recording of witness statements, an important facet of the proceedings was the Special Public Prosecutor asking for the presence of prime accused Nithyananda in court.

“The Special Public Prosecutor has taken strong exception and objected to his absence in court. He asked the court to make it mandatory for all the accused to be present from the next hearing or else he will make an appeal to the court to issue non-bailable warrants,” a source said.

The Supreme Court in December 2017 directed the trial court to dispose of the matter expeditiously.
“Therefore, in view of the directions of the Apex Court, it is incumbent upon the court to proceed with the trial. However, it is for the accused No.1 to be present by next date of hearing,” the trial court observed.
44-year-old Nithyananda has not appeared in court on Wednesdayon the pretext of religious ritual—Chathurmasa Parikrama.  He had last appeared in court on the day, the charges were framed against him,
Nithyananda is accused of raping a woman disciple for close to five years during her stay in the ashram under the garb of spirituality. Nithyananda is facing trial under Sections 376 (rape), 377 (unnatural sex), 420 (cheating), 114 (criminal abetment), 201 (disappearance of evidence, giving false information), 120B (criminal conspiracy) and other charges under the Indian Penal Code (IPC).
The delay
The Bidadi Police Station in Ramanagara in early 2010 had promptly registered a first information report under the mentioned sections based on a complaint filed by a former disciple against the godman with Chennai Police.
The case was soon after transferred to the Central Investigation Department after the Bidadi Police started investigations.
Nithyananda had courted arrest twice in relation to the case but managed to delay the trial by approaching higher courts and changing his stance from time to time. He had also filed a fabricated impotency report. He had also allegedly filed false cases against the victim and witnesses. He had approached the Karnataka High Court four times regarding this case and recently.
In 2014, the Supreme Court dismissed a petition by Nithyananda seeking to quash the chargesheet against him. But in 2017, in a relief for the victim, the apex court asked the Ramanagara sessions court in Karnataka to frame charges against him and conduct a speedy trial.
However, in March 2018, Nithyananda changed his stance on his impotence at the Karnataka High Court, claiming to have had “consensual sex” with the victim – a big U-turn from earlier.
Nithyananda has been in the news for wrong reasons since then, and multiple regional channels had broadcasted a clip of the godman in a compromising position with an actor.

The other accused

Other than Nithayanada, the CID has named five of his aides as the co-accused in the case.
Gopala Reddy (A2), Shiva Vallabhaneni alias Nithya Sachidananda (A3), Danasekaran alias Nithya Sadananda (A4), Ragini alias Maa Nithya Sachidananda (A5) and Jamuna Rani alias Maa Nithyananda (A6) will also be tried in the same case.

While all the other accused have presented themselves at the time of framing of charges, Gopala Reddy (A2) has remained absconding during the whole process.

A non-bailable warrant (NBW) was issued against him for failing to appear despite repeated summons on the last date of hearing in June.

On Wednesday, Danasekaran alias Nithya Sadananda (A4) and Jamuna Rani alias Maa Nithyananda (A6) were present.
The controversial godman is also involved in other legal proceedings, including a case where he is contesting his sacking as a pontiff at Madurai Adheenam Mutt. The Madras High Court had recently warned Nithyananda that it will issue an arrest warrant if he does not rectify his “misleading” affidavits.
The police have been criticised by the Karnataka High Court for not investigating two suspicious deaths in his ashram.

Sexual crimes committed in the name of God: A look back at 'Swami' Nithyananda's 'sex contract'

While Gurmeet Ram Rahim gave ‘maafi’ to devotees, Nityananda followers were allegedly made to sign a contract where they agreed to ‘sexual enlightenment’.

Self-proclaimed godman Gurmeet Ram Rahim Singh has been sentenced to 20 years in prison for the rape of two saadhvis at the Dera Sacha Sauda ashram. But the crime this rapist has been convicted for, is merely the tip of an iceberg shrouded in a dark web of lies and deceit practiced by the 'Guru'.
More horrors in his premises allegedly took place with the consent of followers - castration of male devotees, being the most gruesome of them.
From 2000, over 400 followers were reportedly brought under the scalpel in Dera Sacha Sauda hospital for bringing them closer to God.
But it isn’t just Gurmeet Singh who extracted sexual favours under ‘divine’ pretexts, cloaking them in secrecy. The survivors of sexual assaults in 'Swami' Nithyananda's ashram have spoken out about non-disclosure agreements and sex contracts. The chargesheet of the rape case against Nithyananda reveals that sexual exploitation was masked in the guise of a 'Learning from the Master' programme.
The mental conditioning
The chargesheet filed by the police in the Ramanagara court in November 2010 on a case of rape allegedly committed by Nityananda, speaks of five non-disclosure agreements signed by various victims.
In 2009, a 'special' group of men and women gathered in a room at the Nithyananda Dhyanapeetam, which is led by the 'godman' in Bidadi.
They were not just the regular followers of 'swamiji'. In fact they were a chosen few, who would take care of him and help in the running of his foundation.
On that particular day, they were given two sets of "non-disclosure agreement" contracts to sign in the presence of their leader.
Signing these would make them eligible for the "Learning from the Master" programme. Such was their blind trust in the self-proclaimed godman that most of them signed the papers without even reading the clauses, says the chargesheet.
The 'Sex Contract'
The most appalling section of the 10 page contract included in the chargesheet reads -

"Volunteer understands that the Program may involve the learning and practice of ancient tantric secrets associated with male and female ecstasy, including the use of sexual energy for increased intimacy/spiritual connection, pleasure, harmony, and freedom. Volunteer understands that these activities could be physically and mentally challenging, and may involve nudity, access to visual images, graphic visual depictions, and descriptions of nudity and sexual activity, close physical proximity and intimacy, verbal and written descriptions and audio sounds of a sexually oriented, and erotic nature, etc."

The contract further functioned as a gag order, threatening devotees with consequences if they were to reveal to outsiders.
"By reading and signing this addendum, Volunteer irrevocably. acknowledges that he/she is voluntarily giving his unconditional acceptance of such activities and discharges the Leader and the Foundation, and anyone else not specifically mentioned here but directly or indirectly involved in the organization, management, or conduct of any such programs from any liability, direct or indirect, arising from such activities," read the document.
One such agreement copy signed by the devotee had the date September 3, 2005. The document accessed by TNM clearly carries the name and address of the devotee and of an ashram trustee as well. So, did these followers willingly agree to sexual exploitation under the garb of a 'learning' programme?


"No, we did not," says a survivor, who signed one such document, to TNM.
Speaking to TNM, the survivor says that at the time of signing the documents they were unaware of what it said.
"We were given two copies. One had to be signed along with the date on the that day and the other had to be backdated to the day when we had first met him. So he was pretty much covered legally from the day we met him to any point in the future. Because the contract states that the agreement does not end even if the relationship does. It is like a perpetual binding agreement," the former devotee says.
The survivor further alleges that they were not given time to read the clauses and were told that it was "regular, routine stuff to do with confidentiality".
A few who tried to read the document were accused of wavering devotion. They were asked, "Don't you trust swamiji?"


“We had extreme trust in him and looked at him as someone who was beyond being an ordinary human being. We never even doubted that there could be anything in these documents that could have these kinds of implications,” a survivor said.
Those who tried to question the 'Swami' or his decisions were allegedly dealt with force, threat or intimidation.

Raped for enlightenment?
A chargesheet filed by the Bidadi police in November 2010, narrates how Nityananda 'convinced' one such devotee into having sexual relations with him. The survivor, named Amala* in the chargesheet, was a housewife and pregnant when he first decided to satisfy his 'illicit sexual desire' by using her.
She was brought to his room under the pretext of cleaning it and was asked to massage Nityananda's legs. This was when he allegedly embraced and kissed her on the lips. When she withdrew shocked, he told her that the act was for her enlightenment.
Amala argued that a physical relationship with a saint was wrong but Nityananda allegedly claimed that 'feeling love was a path to enlightenment' and that 'he was God'. The only way to attain spiritual enlightenment was to 'listen and obey his words'.
'Thus he attacked her mind and took control of it and made her go into a state of total surrender' says the chargesheet. It further claims that Amala lost her ability to think clearly and was overcome by blind faith. Following this she was raped multiple times in various hotels and the Bidadi Ashram.
According to the chargesheet, between February and March 2009, the victim "was made to sign, along with others, non-disclosure agreement documents".


The conditioning continues?
Now, with media attention back on self-proclaimed godmen and the exploitation they met out to devotees, several have come out to question the case pending against Nithyanandha.
What is shocking is that despite testimonies of the 'godman' forcing women into sexual activities being made public, a large number of people continue to root for him. When social activist and environmentalist Piyush Manush took to social media to ask about what action has been taken, he was at the receiving end of severe abuse.
Most of the abuse (unsurprisingly) was directed at Piyush’s mother, wife and daughter.


The case now
The case against Nithyananda is currently pending for trial at the Ramanagara sessions court, the trial has not even started. The accused has filed a discharge petition, where they have claimed that there is no prima facie case. Nityananda's counsel has requested that he be discharged without the hardship of trial. The Court's order on the petition is still awaited.
The judge can either order a discharge in which case the self-proclaimed godman will be acquitted without trial or he can order a trial saying there is enough material.
The Supreme Court, meanwhile, has stayed the trial court proceedings based on yet another petition filed by him in 2014 to consider his self-generated medical reports of impotency. Next hearing in the Apex court is scheduled for September 2017.


Nithyananda had earlier sought to be discharged as he was 'impotent' and had test results from an examination conducted in a private hospital to prove the same. However, tests ordered by the Supreme Court proved that the excuse was yet another lie.


In yet another attempt to allegedly evade the law, Nityananda claimed that statement recorded by the CID from 32 witnesses at his ashram must be included in the chargesheet. These were reportedly generic statements glorifying 'swamiji'. While the trial court rejected them as defense documents, the High Court of Karnataka ruled in favour of the 'godman'.


Affidavits and counter affidavits have been filed to delay the case. Though the complaint of rape was registered in 2009, the victim has been pushed from pillar to post, with justice delayed for eight long years. The only hope is that, at least now, justice is not denied.

A former aide of Swami Nithyanand spoke exclusively to Republic TV’s Pooja Prasanna where she narrated the harassment she has been put through for the past seven years and filed complaints of rape against the self-styled Godman. She also revealed the techniques used by him to harass his followers inside the ashram physically, psychologically and sexually. The victim also went on to appeal that his properties be treated in a similar manner as rapist Ram Rahim’s Dera Sacha Sauda so that financial might is taken away and no longer used to harass his detractors.

On being questioned about the kind of techniques being used by Swami Nithyananda to intimidate her, the victim said that Nithyanand has been very smart in implicating her with "all kinds of tactics." She said that all these incidents only began after she filed the chargesheet against Nithyananda. She said, "for a person like Nithyananda if he reads the chargesheet statement,(inaudible) he can very clearly make out who is the person who has made the statement. So after the chargesheet was filed in November 2010, just a month later in December 2010, they filed a retaliatory case against me in Ramnagar."

The victim claimed that she was being wrongly accused of crimes she did not commit. She said, 'I have been running from pillar to post just to prove that I have not committed anything wrong. The person who has actually committed crimes (Nithyananda) is happy sitting in his ashram conducting programmes and carrying on his business of cheating and fooling more and more people."

She also spoke of how Nithyananda allegedly hired people to intimidate her and her family, not only in Bengaluru but other parts of the country as well. She said, "When I say Nithyananda, I include his followers because they don't really have a mind of their own. They act as his apostles and do whatever he says. This is the real challenge that we are facing legally. If a person is really harassing all the witnesses against him, we should get his bail cancelled."

Nithyananda case: SC to hear final arguments on July 17

The Supreme Court on Tuesday fixed July 17 for final arguments in the case related to rape charges against Nithyananda of Dhyanapeetam at Bidadi, Ramanagaram district.

When the case came up for hearing before a three-judge bench headed by Justice Deepak Mishra, Shekhar Naphade, the advocate representing Nithyananda, said a minimum of two hours was required for him to make the submission. The bench said the matter would be heard after the summer vacation and fixed July 17 for final arguments.

The Supreme Court is hearing the Karnataka government’s petition challenging the order of the Karnataka High Court, wherein the prosecution was ordered to provide to the accused the statements of 32 witnesses, including that of a Tamil actress, the CD of whose purported video with the Swami had led to registration of criminal cases.

The high court had also directed furnishing medical records of another victim and her email conversations.

The Karnataka government, represented by additional advocate general Devadutt Kamat, said at this stage, the suspect was not entitled to documents which were not part of the charge sheet.

Nithyananda, facing charges for offences of rape and indulging in unnatural sex, was arrested on April 22, 2010.

He was granted bail on June 11 that year.He was directed by the apex court in 2014 to undergo potency test and give blood and voice samples required for investigation of the case registered on March 4, 2010.

இந்நிலையில், நித்யானந்தா மீதான பாலியல் புகார் வழக்கு நேற்று ராம்நகரம் மாவட்ட முதலாவது செஷன்ஸ் நீதிமன்றத்தில் நீதிபதி மஞ்சுளா முன் விசாரணைக்கு வந்தது. நித்யானந்தா உள்பட அவரது 4 சீடர்கள் நேரில் ஆஜராகினர். அப்போது கர்நாடக சி.ஐ.டி. துணை போலீஸ் கண்காணிப்பாளர் லோகேஷ்குமார், நித்யானந்தாவின் மருத்துவ பரிசோதனை அறிக்கையை தாக்கல் செய்தார். அதை தொடர்ந்து பாலியல் புகார் தொடர்பாக 150க்கும் மேற்பட்ட பக்கங்கள் கொண்ட கூடுதல் குற்றபத்திரிக்கையும் தாக்கல் செய்தனர். அதை தொடர்ந்து நித்யானந்தா சார்பில் புதிய மனு ஒன்றை அவரது வக்கீல் பி.வி.நாகேஷ் தாக்கல் செய்தார். அதில் வரும் டிசம்பர் 10ம் தேதி தென்கொரியாவில்  நடக்கும் கருத்தரங்கில் கலந்து கொள்ள நித்யானந்தா திட்டமிட்டுள்ளார். அவர் வெளிநாடு செல்ல அனுமதிக்க வேண்டும் என்று குறிப்பிட்டிருந்தது. 

அதைப் படித்த நீதிபதி, வெளிநாடு சுற்றுப்பயணம் செய்ய கர்நாடக உயர்நீதிமன்றம் அனுமதி வழங்கியுள்ளதா? என்று  கேட்டார். அனுமதி வழங்கியுள்ளதாக வக்கீல் பதிலளித்தார். அதை கேட்ட நீதிபதி ஐகோர்ட் அனுமதி வழங்கியுள்ள உத்தரவு நகலை தாக்கல் செய்யும்படி உத்தரவிட்டார். பின் உணவு இடைவேளைக்கு பின் வழக்கு மீண்டும் விசாரணைக்கு வந்தபோது நித்யானந்தாவின் வக்கீல் நாகேஷ், எனது கட்சிக்காரருக்கு எதிராக சி.ஐ.டி. போலீசார் தாக்கல் செய்துள்ள மருத்துவ பரிசாதனை அறிக்கை மற்றும் கூடுதல் குற்றபத்திரிக்கை நகல் கிடைக்கவில்லை. இது கிடைத்தபின் வாதம் செய்வதாக கூறினார். அதை அரசு வக்கீலும் ஆமோதித்தார். அதையேற்று விசாரணையை டிசம்பர் 3ம் தேதிக்கு நீதிபதி ஒத்திவைத்தார்.

ஆண் என்பது உறுதி?

இதனிடையில் சி.ஐ.டி. போலீசார் தாக்கல் செய்துள்ள மருத்துவ அறிக்கையில், நித்யானந்தாவை முழுமையாக பரிசோதனை செய்ததில் அவர் ஒரு ஆணுக்கான அனைத்து தகுதியும் பெற்றுள்ளார். தற்போதைய வயதுக்கு ஏற்ற வகையில் உடல் உறுப்புகள் இயங்குகிறது. அவர் தன்னை ஆண் மகனில்லை என்று காட்டிகொள்ளும் முயற்சியை செய்து வருகிறார். மேலும் நித்யானந்தாவிடம் மருத்துவ பரிசோதனை செய்த நாளில் அவர் போதை மாத்திரை எதுவும் சாப்பிடவில்லை. நீரிழிவு நோய் காரணமாக இரண்டு வேளை மாத்திரை சாப்பிட்டுள்ளார். அவரது உடலில் சர்க்கரை அளவு 190ஆக இருந்தது. நீரிழவு நோய் இருப்பதால் ஆண்மை சக்தி இல்லை என்ற வாதம் ஏற்க முடியாது. மேலும் அவரது குரல் பரிசோதனை அறிக்கை இன்னும் கிடைக்கவில்லை. இது தொடர்பாக 10 தமிழ் மருத்துவ நிபுணர்கள் உதவி கேட்டுள்ளோம். அவர்கள் மூலம் பரிசோதனை நடத்திய பின் முழு அறிக்கை தாக்கல் செய்யப்படும் என்று கூறியுள்ளதாக தெரிகிறது.

Bengaluru: The medical report of the self-styled godman Nithyananda, who underwent a potency test at the Institute of Nephro-Urology, which was submitted to the Criminal Investigation Department has proved him to be potent.

As per sources, it is learnt that the results are out and the tests proved positive were enough to assess his potency. CID had submitted 31 page report to the court recently. Meanwhile Nithya has sought permission to travel abroad, however the reason behind his tour is not yet known.

The Supreme Court had directed Nithyananda to undergo a potency test in a 2010 rape case, thus he was subjected to tests on September 8. A bench headed by Justice Ranjana Prakash Desai refused to give any relief to Nithyananda. The bench while hearing the case had on August 20 questioned the controversial godman for his reluctance to undergo the test, saying such examinations are becoming necessary day-by-day in view of rise in rape cases. 

The bench had also said that there is no reason why an accused in a rape case should not be subjected to potency test and had questioned the police for delay in conducting the test in the 2010 case.

The Karnataka High Court had in July affirmed an order of a chief judicial magistrate to subject Nithyananda to medical test to find out whether or not he was capable of having sexual intercourse, and also to collect his blood and voice samples.

ऐसा लगता है कि खुद को धर्मगुरु बताने वाले बाबाओं के दिन अच्छे नहीं चल रहे. 2010 में साउथ एक्ट्रेस युवारानी के साथ सेक्स स्कैंडल में फंसने वाले नित्यानंद पर रेप का आरोप लगा था. इस मामले में सुप्रीम कोर्ट के आदेश के बाद उसका पोटेंसी कराया गया. इन टेस्ट के नतीजों को बुधवार को बेंगलुरु के रामनगरम कोर्ट में दाखिल कर दिया गया है. सेक्स स्कैंडल में घिरे नित्यानंद बने महामंडलेश्वर 
सूत्रों से मिली जानकारी के मुताबिक 31 पन्ने के इस रिपोर्ट में कहा गया है कि नित्यानंद के पौरुषता की जांच की गई और वह बिल्कुल फिट है. मतलब वह नपुंसक नहीं है.

दरअसल, नित्यानंद ने विदेश जाने के लिए अर्जी दी थी. उसने दावा किया था कि बचपन से ही उसके शरीर के अंगों का पूरा विकास नहीं हुआ. पर जांच के बाद डॉक्टर इस नतीजे पर पहुंचे कि नित्यानंद के अंगों का विकास उसकी उम्र के हिसाब से ठीक है.


यह है नित्यानंद पर आरोप 
बेंगलुरु के बाहरी इलाके में नित्यानंद का आश्रम था. वह विवादों में तब आए जब एक स्थानीय चैनल ने उनका एक अभिनेत्री के साथ आपत्तिजनक स्थिति में वीडियो दिखाया. विवाद होने के बाद नित्यानंद अपने आश्रम से रफूचक्कर हो गए. करीब दो महीने की खोज के बाद नित्यानंद का पता चला और उसे हिमाचल प्रदेश से गिरफ्तार किया गया. पुलिस ने उसके चार सहायकों के खिलाफ भी रेप का मामला दर्ज किया. एक अमेरिकी महिला ने आरोप लगाया था कि नित्यानंद ने पांच साल तक उसका रेप किया, हालांकि नित्यानंद इससे इनकार किया. कई महिला अनुयायियों का कहना है कि उनपर नित्यानंद और उसके सहयोगियों के साथ सेक्स करने का दबाव बनाया जाता था.

பெங்களூரு: நித்யானந்தாவின் ஆண்மை பரிசோதனை அறிக்கையை கர்நாடக நீதிமன்றத்தில் சி.ஐ.டி. போலீசார் இன்று (26ஆம் தேதி) தாக்கல் செய்தனர்.

பெங்களூருவில் ஆசிரமம் வைத்து நடத்தி வரும் சாமியார் நித்யானந்தா மீது பல்வேறு பாலியல் புகார்கள் கூறப்பட்டது. இதையடுத்து, தனக்கு ஆண்மை சக்தி இல்லை என தன்னை விசாரித்த போலீசாரிடம் நித்யானந்தா கூறினார்.

The third additional sessions court in Ramanagar on Monday granted conditional bail to controversial godman Nithy- ananda and his five disciples.
The judge directed the accused to furnish a surety for Rs one lakh each and posted the matter to November 26.

Meanwhile, the counsel for the CID filed objections to the application filed by the godman’s advocate seeking details of the investigation. The CID contended that it had already furnished sufficient documents. The court adjourned the matter to Nov 11.

அம்மனு கடந்த ஆகஸ்ட் 16ம் தேதி ஐகோர்ட்டில் விசாரணைக்கு வந்தது.  அதை விசாரணை நடத்திய நீதிமன்றம் இந்த வழக்கை மனுதாரர்  கண்டிப்பாக சந்திக்க வேண்டும். ஆகவே வழக்குகளை ரத்து செய்ய  வேண்டும் என்ற கோரிக்கையை ஏற்க முடியாது. மேலும்  நித்யானந்தாவிடம் ஆண்மை பரிசோதனை செய்ய வேண்டும் என்று  போலீசார் விரும்பினால், அதை செய்யலாம். அதற்கு நித்யானந்தா  ஒத்துழைப்பு கொடுக்க வேண்டும். ஒருவேளை அவர் ஒத்துழைப்பு  கொடுக்க மறுத்தால் கைது செய்து பரிசோதனை செய்ய போலீசாருக்கு  அனுமதி வழங்குவதாக தீர்ப்பில் கூறியது. ஐகோர்ட் தீர்ப்பை எதிர்த்து  உச்சநீதிமன்றத்தில் மேல்முறையீடு செய்தார். அதை விசாரணை  நடத்திய நீதிமன்றம், நித்யானந்தாவின் கோரிக்கையை நிராகரித்ததுடன்,  ஆண்மை பரிசோதனைக்க ஒத்துழைக்க வேண்டும் என்று கடந்த மாதம்  4ம் தேதி உத்தரவிட்டது.

அதைத் தொடர்ந்து பெங்களூரில் உள்ள விக்டோரியா அரசு  மருத்துவமனையில் கடந்த மாதம் 7ம் தேதி நித்யானந்தாவுக்கு  ஆண்மை பரிசோதனையும், அதே நாளில் மடிவாளவில் குரல் சோதனை  நடத்தப்பட்டது. நித்யானந்தாவிடம் நடத்தப்பட்ட பரிசோதனை  அறிக்கையை கடந்த வாரம் டாக்டர்கள் கர்நாடக சி.ஐ.டி. போலீசாரிடம்  ஒப்படைத்தனர். இந்நிலையில் இவ்வழக்கு தொடர்பாக நித்யானந்தா  உள்பட 5 பேரும் அக்டோபர் 27ம் தேதி (நேற்று) நீதிமன்றத்தில்  ஆஜராகும்படி ராம்நகரம் ஜெ.எம்.எப்.சி. நீதிமன்ற நீதிபதி ஹொசகவுடர்  உத்தரவிட்டிருந்தார். அதன்படி, நேற்று காலை 11.30 மணிக்கு  நிதியானந்தா உள்பட அவரது 5 சீடர்கள் நீதிமன்றத்திற்கு வந்தனர்.  சி.ஜெ.எம்.சி. நீதிமன்ற நீதிபதி ஹொசகவுடர் முன் ஆஜராகினர். அதைத்  தொடர்ந்து பல்வேறு புகாரில் போலீசார் தன்னை கைது செய்யாமல்  இருக்க முன்ஜாமீன் வழங்கக்கோரி கடந்த மாதம் நித்யானந்தா தாக்கல்  செய்திருந்த மனு மற்றும் மூல வழக்கு விசாரணையை நவம்பர் 11,26ம்  தேதிக்கு நீதிபதி  ஒத்திவைத்தார்.

Press Release by Lenin - Clarifying Nithyananda's False News

Yesterday a very damaging false news has been published by ANI, claiming that Nithyananda's medical test reports confirm that he is impotent, and that the rape charges are false! There are several false, defamatory and misleading statements, which are clarified below.
 

I assume that a reputed and responsible media like ANI will NOT intentionally mislead the public with some vested interest or hidden motive. But it appears from the news article that your office has not verified with the CID re. the (false) informations given by Nithyananda. Here are the facts for your information:

1. Medical test results of Nithyananda have NOT yet been released by the CID. They have been submitted in sealed cover and CID is likely to submit it to the court along with the final charge sheet, which is the normal procedure.

2. According to CID (you can clarify with DGP, CID, 080-22256963) the news that medical test reports have found Nithyananda to be incapable of sexual acts is absolutely false & malicious.
 
3. As per Supreme Court orders, identity of Rape victims must NOT be exposed in media. It is quite shocking to see a reputed media like ANI mentioning the victim's name and blatantly assassinating her character.

It is deplorable to see ANI becoming a tool in the hands of rape accused & publicly attacking a rape victim, at a time when the entire nation is standing against rapes and rape laws have been strengthened to help victims to find speedy justice. In this very Nithyananda case, even the Hon'ble Supreme Court had ordered Nithyananda to stop delaying the case, and instead to go to trial soon and come out clean.

4. Please see attached FSL report. Topmost forensic lab in the country, Central Forensic Science Lab has confirmed in 2010 itself that sex video of Nithyananda is authentic, it is NOT morphed. Nithyananda's alleged US forensic reports are questionable as he does not have the original video.

5. Nithyananda made all the victims and close disciples to sign a sex-contract. Please see attached sex-contract (Non-Disclosure Agreement), refer underlined sections in pages 8, 9 and also pages 4 & 5.

6. Nithyananda confessed to whistle blower Lenin in 2010 about his sexual acts. See attached Audio confession between Nithyananda& whistle blower Lenin. In 2010, Nithyananda himself confessed to several witnesses that he had relationship with several women.

ANI has done great disservice not only to the victims in the case, but has tremendously misled the trusting public to repose faith in a fake Godman, a rape accused, a cult leader, even before tile court has examined the case in detail in a trial and even before Court can give a just verdict.

It is absolutely essential and expected that as a responsible media you immediately withdraw the article with completely false & misleading information. Further ANI is obligated to the public to clarify the facts with accurate information from the real source such as CID and based on actual documents in the chargesheet.

Please do the needful without further delay to undo the great damage done to the public and to Hindus.

Self Styled God Man Swamy Nithyananda

Bengaluru: Controversial self-styled godman Nithyananda, along with five other accused, appeared before the Chief Judicial Magistrate Court (CJMC), Ramnagara on Wednesday. The case came up for hearing around 11.30 am and went on till around 12.45 p.m. It was adjourned to October 27.

It was the 3rd Additional Sessions Court Ramanagara that was hearing the case, but as presiding officer Manjula was on leave, the Chief Judicial Magistrate Court Ramanagara was directed to hear the case and a special public prosecutor was appointed. “As the case was called, the accused, Nithyananda, and five others filed bail petitions. As the Chief Judicial Magistrate Court was an in-charge court, the case was adjourned to October 27 for objections to be filed by the prosecution,” said Mr K. Gopal Rao, Senior Assistant Public Prosecutor, CJM Court.

Though Nithyananda agreed to a potency test following a Supreme Court order, the godman refused to take the very injection that was crucial to determine the potency of an individual. He claimed to the doctors in Victoria Hospital that he would suffer a cardiac arrest if he was injected with the drug.

He was also adamant in not taking the injection as it was not mentioned in the court order. The interim potency test reports and voice test results were handed over by the medical team from Victoria Hospital and the Forensic Sciences Laboratory in Madiwala to the CID officials recently.

An NRI filed a rape complaint against Nithyananda in 2010, alleging that she was repeatedly sexually assaulted over five years in Nithyananda’s ashram and was threatened with dire consequences if she revealed it to anyone.

Then Karnataka Chief Minister D.V. Sadananda Gowda in June 2012 had ordered the arrest of Nithyananda after several of his followers appeared on vernacular Kannada TV news channels and accused the godman of exploiting them sexually. Cases of rape and unnatural sex were registered against Nithyananda and five others at the Bidadi police station.

பெண் சீடர் தொடர்ந்த பாலியல் வழக்கு : ராம்நகரம் நீதிமன்றத்தில் நித்யானந்தா ஆஜர் கருத்துகள் ராம்நகரம்: தியானபீட மடாதிபதி நித்யானந்தா மீது முன்னாள் பெண் சீடர் ஆரத்திராவ் கொடுத்த பாலியல் புகார் தொடர்பாக நித்யானந்தா அவரது 5 சீடர்களுடன் ராம்நகரம் நீதிமன்றத்தில் நேற்று ஆஜரானார். கர்நாடக மாநிலம், ராம்நகரம் மாவட்டம், பிடதியில் உள்ள தியானபீட ஆசிரமத்தின் மடாதிபதி நித்யானந்தா மீது கர்நாடகாவில் பல வழக்குகள் பதிவாகியுள்ளது. கடந்த இரண்டாண்டுகளுக்கு முன்பு ஆசிரமத்தின் முன்னாள் பெண் சீடர் ஆரத்தி ராவ் கொடுத்த பாலியல் புகார் தொடர்பாக பிடதி போலீசார் நடத்திய விசாரணையில் தனக்கு ஆண்மை சக்தி இல்லை என்று கூறியிருந்தார். அதை மறுத்த பிடதி போலீசார், நித்யானந்தா வுக்கு ஆண்மை பரிசோதனையும், ரத்த பரிசோதனை நடத்த அனுமதி கோரி ராம்நகரம் மாவட்ட அமர்வு நீதிமன்றத்தில் மனு தாக்கல் செய்தது. அதையேற்று பரிசோதனைக்கு ஒத்துழைக்கும்படி நித்யானந்தாவுக்கு கோர்ட் உத்தரவிட்டது. மாவட்ட அமர்வு நீதிமன்றத்தின் தீர்ப்பை எதிர்த்து கர்நாடக ஐகோர்ட்டில் மேல்முறையீட்டு மனு தாக்கல் செய்யப்பட்டது.  அம்மனு கடந்த ஆகஸ்ட் 16ம் தேதி ஐகோர்ட்டில் விசாரணைக்கு வந்தது. அதை விசாரணை நடத்திய நீதிமன்றம் இந்த வழக்கை மனுதாரர் கண்டிப்பாக சந்திக்க வேண்டும். ஆகவே வழக்குகளை ரத்து செய்ய வேண்டும் என்ற கோரிக்கையை ஏற்க முடியாது. மேலும் நித்யானந்தாவிடம் ஆண்மை பரிசோதனை செய்ய வேண்டும் என்று போலீசார் விரும்பினால், அதை செய்யலாம். அதற்கு நித்யானந்தா ஒத்துழைப்பு கொடுக்க வேண்டும்.  ஒருவேளை அவர் ஒத்துழைப்பு கொடுக்க மறுத்தால் கைது செய்து பரிசோதனை செய்ய போலீசாருக்கு அனுமதி வழங்குவதாக தீர்ப்பில் கூறியது. ஐகோர்ட் தீர்ப்பை எதிர்த்து உச்சநீதிமன்றத்தில் மேல்முறையீடு செய்தார். அதை விசாரணை நடத்திய நீதிமன்றம், நித்யானந்தாவின் கோரிக்கையை நிராகரித்ததுடன், ஆண்மை பரிசோதனைக்கு ஒத்துழைக்க வேண்டும் என்று கடந்த மாதம் 4ம் தேதி உத்தரவிட்டது. அதைத் தொடர்ந்து பெங்களூரில் உள்ள விக்டோரியா அரசு மருத்துவமனையில் கடந்த மாதம் 7ம் தேதி நித்யானந்தாவுக்கு ஆண்மை பரிசோதனையும், அதே நாளில் மடிவாளவில் குரல் பரிசோதனை நடத்தப்பட்டது. நித்யானந்தாவிடம் நடத்தப்பட்ட பரிசோதனை அறிக்கையை கடந்த வாரம் டாக்டர்கள் கர்நாடக சி.ஐ.டி. போலீசாரிடம் ஒப்படைத்தனர். இந்நிலையில் இவ்வழக்கு தொடர்பாக நித்யானந்தா உள்பட 5 பேரும் அக்டோபர் 15ம் தேதி (நேற்று) நீதிமன்றத்தில் ஆஜராகும்படி ராம்நகரம் மாவட்ட செஷன்ஸ் கோர்ட் நீதிபதி மஞ்சுளா உத்தரவிட்டிருந்தார்.  அதன்படி, நேற்று காலை 11.15 மணிக்கு நிதியானந்தா உள்பட அவரது 5 சீடர்கள் நீதிமன்றத்திற்கு வந்தனர். செஷன்ஸ் கோர்ட் நீதிபதி மஞ்சுளா விடுமுறையில் இருந்ததால், நீதிபதி ஹொச கவுடர் முன் ஆஜராகினர். அதை தொடர்ந்து பல்வேறு புகாரில் போலீசார் தன்னை கைது செய்யாமல் இருக்க முன்ஜாமீன் வழங்கக் கோரி கடந்த மாதம் நித்யானந்தா தாக்கல் செய்திருந்த மனு மற்றும் மூல வழக்கு விசாரணையை அக்டோபர் 27ம் தேதிக்கு நீதிபதி ஹொச கவுடர் ஒத்திவைத்தார்.
