Nithyananda case: SC to hear final arguments on July 17

The Supreme Court on Tuesday fixed July 17 for final arguments in the case related to rape charges against Nithyananda of Dhyanapeetam at Bidadi, Ramanagaram district.

When the case came up for hearing before a three-judge bench headed by Justice Deepak Mishra, Shekhar Naphade, the advocate representing Nithyananda, said a minimum of two hours was required for him to make the submission. The bench said the matter would be heard after the summer vacation and fixed July 17 for final arguments.

The Supreme Court is hearing the Karnataka government’s petition challenging the order of the Karnataka High Court, wherein the prosecution was ordered to provide to the accused the statements of 32 witnesses, including that of a Tamil actress, the CD of whose purported video with the Swami had led to registration of criminal cases.

The high court had also directed furnishing medical records of another victim and her email conversations.

The Karnataka government, represented by additional advocate general Devadutt Kamat, said at this stage, the suspect was not entitled to documents which were not part of the charge sheet.

Nithyananda, facing charges for offences of rape and indulging in unnatural sex, was arrested on April 22, 2010.

He was granted bail on June 11 that year.He was directed by the apex court in 2014 to undergo potency test and give blood and voice samples required for investigation of the case registered on March 4, 2010.

Self Styled God Man Swamy Nithyananda

Bengaluru: Controversial self-styled godman Nithyananda, along with five other accused, appeared before the Chief Judicial Magistrate Court (CJMC), Ramnagara on Wednesday. The case came up for hearing around 11.30 am and went on till around 12.45 p.m. It was adjourned to October 27.

It was the 3rd Additional Sessions Court Ramanagara that was hearing the case, but as presiding officer Manjula was on leave, the Chief Judicial Magistrate Court Ramanagara was directed to hear the case and a special public prosecutor was appointed. “As the case was called, the accused, Nithyananda, and five others filed bail petitions. As the Chief Judicial Magistrate Court was an in-charge court, the case was adjourned to October 27 for objections to be filed by the prosecution,” said Mr K. Gopal Rao, Senior Assistant Public Prosecutor, CJM Court.

Though Nithyananda agreed to a potency test following a Supreme Court order, the godman refused to take the very injection that was crucial to determine the potency of an individual. He claimed to the doctors in Victoria Hospital that he would suffer a cardiac arrest if he was injected with the drug.

He was also adamant in not taking the injection as it was not mentioned in the court order. The interim potency test reports and voice test results were handed over by the medical team from Victoria Hospital and the Forensic Sciences Laboratory in Madiwala to the CID officials recently.

An NRI filed a rape complaint against Nithyananda in 2010, alleging that she was repeatedly sexually assaulted over five years in Nithyananda’s ashram and was threatened with dire consequences if she revealed it to anyone.

Then Karnataka Chief Minister D.V. Sadananda Gowda in June 2012 had ordered the arrest of Nithyananda after several of his followers appeared on vernacular Kannada TV news channels and accused the godman of exploiting them sexually. Cases of rape and unnatural sex were registered against Nithyananda and five others at the Bidadi police station.

Doctors Press meet re. Nithyananda Medical Test - Samaya News 15-9-2014

Dr. Durganna, Medical Superintendent of Victoria Hospital submitted the Medical Test Report of Nithyananda swami to the CID in a sealed cover today. After that, he along with a Forensic Expert doctor gave a press conference addressing all the media. The doctor refused to divulge the results of the potency test, but instead he read out a written statement and also clarified many doubts that have been circulating in the media. The following key points are understood from this press meet: 1. Doctors did NOT show any blue/pornographic film or use any women for the potency test of Nithyananda. This is a baseless allegation. 2. All tests were done only with the consent of Nithyananda. 3. Necessary tests to which Nithyananda gave his consent were only conducted. However, he did NOT give his consent for the 'Penile Doppler Ultrasound' with 'Intra-Cavernous Injection' Test. So this test was NOT conducted. 4. All the concerned doctors have signed the test report. 5. Whatever legal notice doctor has received from Nithyananda, he will reply to it legally. 6. No audio or video has been recorded during the potency test as it is not permitted. 7. Rights of Mr. Nithyananda have not been violated in anyway, confirmed the forensic doctor. The doctor also stated that someone sent him email NOT to conduct potency test on Nithyananda. He said he has not replied to it, because its his duty to do as the govt. directs him to do, not to listen to some stranger about conducting the test or not. The actual results of the potency test are yet to be revealed.

Today, 1 week after Nithyananda's medical test for sexual potency (conducted last Monday, on 8th Sep 2014), the doctors of Victoria Hospital have handed over the test reports to the CID. The doctors have not yet disclosed the results of the tests. So the actual contents of the report remain unknown as of now. பின்னர் இந்த வழக்கிற்காக பிடதி போலீஸார் நித்தியானந்தாவுக்கு ஆண்மைப் பரிசோதனை செய்ய வேண்டும் என நீதிமன்றத்தில்  அனுமதி கேட்டு  மனுதாக்கல் செய்தனர். போலீஸாரின் மனுவை விசாரித்த ராம்நகர் நீதிமன்றம், ஆண்மை பரிசோதனை செய்ய அனுமதி அளித்தது. மேலும் 'நித்தியானந்தா இந்த ஆண்மை பரிசோதனைக்கு முழு ஒத்துழைப்பு கொடுக்க வேண்டும்’ என்றும் உத்தரவிட்டது. 

இதனால் அதிர்ச்சி அடைந்த நித்தி, இந்த உத்தரவுக்கு கடும் எதிர்ப்பு தெரிவித்ததோடு கர்நாடக உயர் நீதிமன்றத்தில் மேல்முறையீடு செய்தார்.  அவரது மனு கர்நாடக உயர் நீதிமன்றத்தில் தள்ளுபடி ஆனது.

அதன்பின்னர் ராம்நகர் நீதிமன்றம் ஆகஸ்ட் 6-ம் தேதி பெங்களூரு விக்டோரியா அரசு மருத்துவமனையில் நித்தியானந்தாவுக்கு ஆண்மைப் பரிசோதனை செய்ய உத்தரவிட்டு நோட்டீஸ் அனுப்பப்பட்டுள்ளது. அந்த நாளில் நித்தியானந்தா மருத்துவமனைக்கு வந்து எங்களுக்கு ஒத்துழைப்பு கொடுக்க வேண்டும்’ என்று வாதிட்டார். அதற்கு நித்தியானந்தா வழக்கறிஞர் முத்து மல்லையா, 'ஸ்வாமி ஆன்மிகப் பயணமாக ஹரித்வார் சென்றிருப்பதால் போலீஸார் திட்டமிட்டுள்ள நாளில் ஸ்வாமி வர இயலாது. ஆகவே அவருக்கு விலக்கு அளிக்க வேண்டும்’ என்றார்.

இந்த வழக்கை விசாரித்த நீதிபதி ஹொசகவுடர், 'நித்தியானந்தாவுக்கு போலீஸார் திட்டமிட்ட ஆகஸ்ட் 6-ம் தேதி கண்டிப்பாக ஆண்மை பரிசோதனை செய்ய வேண்டும். அதையடுத்து 7-ம் தேதி இந்த நீதிமன்றத்தில் அவரை கைதுசெய்து ஆஜர்படுத்த வேண்டும். வெளியே தப்பித்துச் செல்லாமல் இருக்க பிடிவாரன்ட் பிறப்பித்து உத்தரவிடுகிறேன்’ என்று கூறியுள்ளார்.

Story:
Controversial godman Swami Nithyananda claims he is impotent. Not sure whether he is telling the truth or just trying to escape allegations of rape, the state’s investigative agency, CID, will subject him to medical tests.

The sleuths are taking no chances. They have written to the Victoria Hospital top brass to constitute a medical board to examine him. “We do not want one doctor testing him and later Nithyananda countering it. We are waiting for the hospital’s reply,” said a source.

Nod for audio test

The Ramanagaram court, before which Nithyananda was produced, granted the CID the go-ahead for conducting the medical test. It also gave the nod for a voice test to know if his voice matched with that in the audio samples submitted by Nithyananda’s detractors.

Sources said Nithyananda has submitted a medical report by a private doctor which claims he is impotent. Meanwhile, the CID has decided not to arrest Nithyananda for conducting these tests. Once the board is formed, they will send him a notice asking him to voluntarily appear for the tests. “If he fails, then the question of arresting him will arise,” sources said.

What are the tests a man has to go through to prove he’s impotent? Considering the sensitivity of the case, details pertaining to the panel of doctors who will be carrying out the tests on Nithyananda are kept highly confidential to check any attempts to influence them, sources said.

So, we asked a few doctors in the city, without mentioning that the person in question was Nithyananda, and here’s the light they threw on this rarely-discussed topic:

Normally, along with the blood samples, the bone marrow is also tested to assess the hormonal levels. But in Nithyananda’s case, it could go beyond this and several tests will be conducted over three-four days. These include: Blood test, supplemented with semen analysis, thyroid analysis and the use of erection-stimulating drugs.

Nithyananda will first undergo a physical examination which will tell doctors if his sexual organs have been operated on.

“Then, they will look at the possibility of erectile dysfunction. Then comes the semen analysis in which semen motility, semen count and semen appearances are tested. The sperm count and quality will throw light on whether the person is impotent. If he meets minimal standards in each of these tests, he will be considered potent,” Dr K Shastri, a city-based physician said.

An analysis of the thyroid – a major regulatory hormone – will also throw light on his infertility. According to Dr Priya Chinnappa, endocrinologist, “Low levels of T4 hormones result in a low sperm count.”

“Injecting erection-stimulating drugs is another important way to test if one is potent. An impotent person will never develop an erection even if he is injected with such drugs. However, this is not related to fertility. Men with a low sperm count will be able to get an erection with these drugs,” Dr C Ashwath, a physician, said.

Testosterone, FSH (follicle-stimulating hormone), LH (luteinizing hormone) are some other tests to determine impotence.

The results of these tests will be produced in court and will determine the course of investigation into the case filed against him by one-time confidant Lenin Karuppan.

“If the tests do not prove his impotence, Nithyananda will be in trouble,” another source added.

Steps sought to oust controversial godman Nithyananda

MADURAI: An orator and an advocate have filed a petition in the high court bench here seeking a directive to the HR&CE Board Commissioner to permit them to file a suit in a subordinate court for removal of controversial godman Nithyananda as head of the Madurai Adheenam.
In their petition, Nellai Kannan and advocate V P Ganesan said Nithyananda was not qualified to become junior head of the adheenam, which was in existence for over 1,500 years and had a great tradition. His appointment had come as 'a bolt from the blue' for the Vallala community, who are Saivites and emotionally attached to the mutt, they said.

They contended that Nithyananda had not followed any of the steps required traditionally to head the mutt, one of which was to acquire a certain type of 'sainthood.' On attaining this status, he should visit all Shiva temples and be made 'Kattalai Thambiran' (personal assistant to the priest) after the latter felt he had acquired sufficient knowledge in Saiva tenets.

He would later be given blessings with mantras and adorn Vedic beads and renounce all worldly connections. He would then be given a 'Spatika Lingam' which he should worship daily.

Directive sought to HR&CE for permission to remove Nithyananda

 Madurai: A petition has been filed in Madras High Court seeking removal of controversial godman Nithyananda as the head of Madurai Adheenam, the oldest Saivite Mutt in south India.

The petition filed by an advocate and an orator at the Madurai bench of the high court, seeks a directive to the HR&CE Board Commissioner to permit them to file a suit in a subordinate court for the removal of Nithyananda as head ogf the Mutt.

In their petition, orator Nellai Kannan and advocate V P Ganesan, said Nithyananda was not qualified to become junior head of the Adheenam, which was in existence for over 1,500 years and had a great tradition.

His appointment had come as 'a bolt from the blue' for the Vallala community, who are Saivites and emotionally attached to the Mutt, they said.

They contended that Nithyananda had not followed any of the steps required traditionally to head the Mutt,one of which was to acquire a certain type of 'sainthood.'On attaining this status,he should visit all Shiva temples and be made 'Kattalai Thambiran' (personal assistant to the priest) after the latter felt he had acquired sufficient knowledge in Saiva tenets.

He would later be given blessings with mantras and adorn vedic beads and renounce all worldly connections.He would then be given a 'Spatika Lingam (linga made of precious stone) which he should worship daily.

New video shows Nithyananda celebrating near his father's body

Mumbai/Bangalore, Jul 11: A new sensational video has surfaced of self-styled godman Swami Nithyananda celebrating near his father's dead body.

The 49-second video was filmed in December 2010 but it surfaced this month. The video was taken by a former female devotee of Nithyananda.

In the video, Nithyananda is clapping, swaying and celebrating in front of his father's body, with a bhajan being blared in the background.

The video suddenly cuts to show an aged man swaying and clapping and touching Nithyananda's feet. The aged man is none other than his father, when he was alive.

Nithyananda hugs his father after the latter touches his feet.

The next part of the video shows Nithyanand handing over a piece of paper to his father, and saying something on the mike.

The piece of paper says, "your son is your guru, and the father's name is now Nithya Arunachalananda".

The father accepts the new name from his son "guru".

The last part of the video shows, Nithyananda picking up  a pair of wooden slippers kept near the feet of his dead father's body.

Nithyananda then proceeds to put the pair of wooden slippers on his father's head, signalling that his father has died a sanyasin.

Nithyananda whistleblower surrenders to CID’s crime branch in TN

In a sudden, yet significant development, Lenin Karuppan, the whistleblower who exposed Bidadi-based Nithyananda in March 2010, surrendered before the state CID’s Crime Branch in Chennai on Wednesday.

Police said that Lenin appeared at the CB-CID headquarters in Guindy and presented himself to the police authorities. He was accompanied by his advocate.

The “whistle-blower” also faces charges of leaking the sleazy video tape featuring Nithyananda and his woman disciple at their ashram in Bidadi near Bangalore.

Ranjitha later denied any such involvement with him and claimed it was a morphed picture to defame her and the “spiritual guru”. The tapes created a sensation when it was shown on a particular Tamil TV news channel in March 2010. Subsequently, the Karnataka CID arrested Nithyananda in Solan, Himachal Pradesh.

Lenin was wanted by the CB-CID in connection with a complaint filed by Nithyananda that he had threatened him and asked for money over the video tapes last year.

Lenin, however, has denied the allegations, claiming that Nithyananda wanted to get even with him by filing “false cases”.

CHENNAI: Lenin Karuppan surrendered before CB-CID sleuths on Wednesday. The CB-CID registered a case against Lenin Karuppan, a former aide of Nithyananda, after Nithya Athmaprabhananda, manager of Nithyananda's ashram, complained that Lenin had demanded crores of rupees to keep the tapes a secret.

Lenin, who was brought before CB-CID officials by his lawyer Sumathi, was taken into custody by deputy superintendent of police Barani Kumar, who is investigating the case, and interrogated. "After conducting a detailed interrogation, if needed, we will arrest Lenin," inspector general of police (CB-CID) Manjunatha said.

Police, however, refused to divulge the information revealed by Lenin during his interrogation. On July13, 2011, Nithya Atmaprabhananda, a devotee of Nithyananda and manager of his ashram, filed a complaint with the Chennai police commissioner against the then Sun Network chief operating officer Hansraj Saxena, his assistant Iyyappan, 'Nakkheeran' Gopal and Kamraj, Lenin Karuppan, his brother Kumar and some others, levelling charges of extortion, criminal intimidation, criminal conspiracy, etc., in connection with the release of the video.

Lenin Karuppan and his brother Kumar filed anticipatory bail petitions that were rejected by the sessions court concerned in Chennai. They moved the Madras high court on September 6, 2011 for anticipatory bail but were again refused bail. Four days later, Hansraj Saxena and Iyyappan were arrested and taken into judicial custody.

Dharmananda (Lenin) Welcomes Custody - Continues His Struggle for Truth

It is a sad day for the supporters of truth and dharma as we post this message received yesterday. We are proud of Dharmananda (Lenin) for having the courage to become a whistleblower and stand up to Nithyananda and his cult. But we know that in this struggle for the truth, the divine will always be on the side of dharma and the truth will ultimately prevail, despite the setbacks.

Greetings from Dharmananda (alias Lenin Karuppan), the whistle blower who exposed the real face of Nithyananda. Self-­‐declared Avatar Nithyananda and his organizations are facing fraud charges in US from a devotee who lost crores of dollars, just like many others. There is information from US that Nithyananda also owns many benami companies there.

To confuse and misdirect the public and judiciary, many false cases are being filed, particularly against me and other important witnesses. In the case filed against me in Tamil Nadu, Nithyananda has successfully blocked my Anticipatory Bail petition. I am ready and willing to cooperate with Tamil Nadu police anytime. I always have respect and gratitude for Tamil Nadu police. They gave me protection when I escaped from Nithyananda and filed an FIR in 2010. Later I had chance to meet some senior people, and I have deep respect for their commitment to duty. In view of this I humbly wish to state that I will give full cooperation for bringing out the truth. I am surrendering to the Tamil Nadu CID today (14/03/2012).

Until now I was silent because I sincerely believed that getting Anticipatory Bail in the false case should not be difficult and my lawyer advised me to be patient. I have no reason to be afraid and I am always ready to cooperate for the sake of truth. I am happy I helped many innocent victims and devotees by exposing Nithyananda’s real face. Many devotees have thanked me personally for saving them. Their gratitude and good will is a great source of strength. And it will help me to fight against corruption and false propaganda. I am not afraid to stand for truth even though I am paying a heavy price for it. I will continue to fight against Nithyananda’s fraud!

I am willing to be in custody because I know that Truth will definitely win and my sacrifice will help many more in future! I profusely thank the media, which helped me by publishing true information, and the public for their support.

Did Ranjitha Coach Sathyananda Heroine?!!

Movie Sathyananda, bearing resemblence to Nithyananda is being produced in Bangalore. The heroine in the movie, Anuki revealed some shocking information. She says, "Ranjitha was supposed to be the heroine in the movie, but later when I was given the role she congratulated me and gave me tips on how to act, including how my body language should be!"
