Karnataka HC stays medical test on Nityananda

7.8.2012 (UNI) Self-styled godman Nityananda was granted interim stay till tomorrow from medical test by Karnataka High Court today.

A Court in Ramanagar had on June 20 granted police permission to subject Nithyananda to a medical test as sought by the CID in a sex scandal case in 2010 reportedly involving him. http://www.blogger.com/blogger.g?blogID=8548474726098828340#editor/src=dashboard

The CID had approached the court at Ramanagar for permission to subject Nithyananda to medical tests including a blood sample and also a voice test.

Nithyananda is facing a CID probe into allegations of rape and criminal intimidation levelled against him in 2010 after some TV channels telecast purported video footage of the self-styled godman in a compromising position with an actress.

He has contended that even if the medical examination were to indicate that he is capable of having an intercourse it does not indicate that there exists evidence with regard to the commission of offence of rape.

Nithyananda has also filed a memo stating the investigating officer M N Ramalingappa, who had filed a report in the Ramnagar Court saying he has to be sent for medical test, does not have authority since Ramalingappa was directed to hand over the case for further investigation to Deputy Superintendent of Police (CID) B N Ambiger.  பெங்களூரு :மருத்துவ பரிசோதனைக்கு விலக்கு கோரிய, நித்யானந்தா மனு மீதான விசாரணை, கர்நாடகா உயர்நீதிமன்றத்தில் இன்று நடக்கிறது. நித்யானந்தா தொடர்பான வழக்கை விசாரித்து வரும், கர்நாடகா சி.ஐ.டி., போலீசார், அவருக்கு மருத்துவ பரிசோதனை செய்யவேண்டும் என,ஏழு முறை நோட்டீஸ் அனுப்பியும், அவர் நேரில் ஆஜராகாமல் போலீசாருக்கு, டிமிக்கி கொடுத்து வந்தார். வழக்கு நடந்து வரும் ராம்நகர் நீதிமன்றத்தில், வழக்கின் உண்மை தன்மை வெளியே வர வேண்டுமானால், நித்யானந்தாவுக்கு மருத்துவ பரிசோதனை செய்ய வேண்டும். பல முறை நோட்டீஸ் அனுப்பியும் பரிசோதனைக்கு வரவில்லை என, சி.ஐ.டி., போலீசார் மனு தாக்கல் செய்தனர். இதை விசாரித்த நீதிமன்றம், ஜூலை 30ம் தேதி, நித்யானந்தாவுக்கு, பெங்களூரு விக்டோரியா மருத்துவமனையில் மருத்துவ பரிசோதனை நடத்த வேண்டும். நித்யானந்தா ஒத்துழைப்பு கொடுக்க வேண்டும் என,உத்தரவிட்டது. ஆனால், அவர் ஆஜராகாமல், தன் சீடர்களுடன் புனித யாத்திரையாக மானசரோவர் சென்றார். நடிகை ரஞ்சிதாவும் சென்றுள்ளதாக கூறப்படுகிறது. முன்னதாக, ராம்நகர் நீதிமன்றத்தில் நித்யானந்தா சார்பில், ஆறு மாதங்களுக்கு முன்னரே மானசரோவர் புனித யாத்திரை செல்ல திட்டமிட்டதால், ஜூலை 30 மருத்துவ பரிசோதனைக்கு வர இயலவில்லை. எனவே, ஆகஸ்ட் 25க்கு பின்னர் மருத்துவ பரிசோதனை செய்ய அனுமதிக்க வேண்டும் என, மனு தாக்கல் செய்யப்பட்டது. இதை எதிர்த்து சி.ஐ.டி., தரப்பில் மனு தாக்கல் செய்யப்பட்டது. மனுவில், நீதிமன்றத்தை நித்யானந்தா அவமதித்துள்ளதால், அவரை கட்டாயப்படுத்தி, பரிசோதனைக்கு அழைத்து வர வைக்க வேண்டும் என்று குறிப்பிட்டிருந்தனர். இந்த மனு மீதான விசாரணை, ஆகஸ்ட் 9ம் தேதி வரவுள்ளது. இந்நிலையில், கர்நாடகா உயர்நீதிமன்றத்தில், நித்யானந்தா தரப்பில் தாக்கல் செய்த மனுவில், மானசரோவர் புனித யாத்திரை சென்றுள்ளதால், ராம்நகர் நீதிமன்ற உத்தரவின் படி மருத்துவ பரிசோதனைக்கு ஆஜராக முடியவில்லை. எனவே, மருத்துவ பரிசோதனையிலிருந்து விலக்களிக்க வேண்டும் என, குறிப்பிட்டிருந்தார். இந்த மனுவை நேற்று விசாரித்த நீதிபதி, இன்று (நேற்று) ஒரு நாள் விலக்கு அளித்தும், மனு மீதான விசாரணை (நாளை) நடக்கும் என்று அறிவித்தார்.
