Nithyananda’s Misrepresentations and False Allegations Against Aarthi Rao Clarified

Nithyananda has made slanderous attacks on the victim Aarthi Rao (alias Ma Nithyananda Premeshwari Mayi) for speaking out against him, just like he has attacked every person who publicly spoke out against him in the past! Below is a clarification to these allegations shared with the press, which we received recently. Our prayers and support to her and her family, and to all other victims and witnesses.

Nithyananda’s Misrepresentations and False Allegations Against Aarthi Rao Clarified

Following are facts to clarify the various misrepresentations and false ideas spread by Nithyananda and his supporters about Aarthi Rao.

· Allegation: A US court has given a money judgment against Aarthi Rao for theft of trade secrets, fraud, etc.

Fact: This is a LIE. There is NO SUCH judgment against Aarthi Rao by the US court. This case is still OPEN. This can be verified by anyone from US court website (case no. RIC1105004 filed in Superior Court of California at Riverside County).

By Nithyananda’s own admission his programs teach simple, time-tested techniques taken from various past masters like Patanjali and Osho. Moreover, all their meditation and yoga techniques have been published and widely circulated by the Nithyananda ashram as books, CDs, DVDs and even provided free of cost on their own website. What is this “trade secret” which Nithyananda alleges she has stolen?

· Allegation: She is ABSCONDING and hiding from the law.

Fact: Absolutely Not. She has been lawfully defending herself in the only summon she has received in the USA. She has been facing grave threats to her physical safety since charge sheet was filed with her victim statement. She has reported these threats to the India and US authorities. In addition, now based on lawyer’s advise to seek legal protection she will be filing for AB. Once her safety can be ensured, legally and physically she will make herself available and address the press.

· Allegation: She is an educated person from BITS Pilani, What took her so many years to complain?

Fact: Unfortunately CULT removes all reason and independent will of its members. As Aarthi reported in the charge sheet and explained in her interviews: exactly this question is what drove her to depression and suicide; but after learning about cults she realized she is a victim of cult brainwashing, which removed her logical thinking. She realized later that it was not just her, but so many other educated devotees including psychologists, doctors, businessmen were brainwashed and exploited to give up their wealth, their services and their life to Nithyananda mission. They all regretted it later. Please see attachments for a case study of an educated woman who was abused in a cult for 20 years before she realized and left. Also see cultic practices experienced in Nithyananda Mission by Aarthi.

· Allegation: She carries a dangerous disease like HIV and came to ashram only for healing. Her healing request has been recorded on video.

Fact: Nonsense. Neither she has any ailment like HIV AIDS nor she went to ashram for any healing. Nithyananda is challenged to make the alleged healing videos public, it will be confirmed that she never made any such request for healing. She was only interested in social service and spirituality, that’s the only reason she dedicated her life as a volunteer in Nithyananda mission. She will be willing to take any medical test if and when required in the main trial.

· Allegation: She was only a causal visitor to ashram and never been in personal service of Nithyananda.

Fact: RIDICULOUS! Nithyananda gave her the name “Ma Nithyananda Premeshwari Mayi”, and made her one of the few privileged “Mothers”. Only 20 women out of thousands in Nithyananda mission have been given this privilege by Nithyananda. In an email sent to her as recently as Feb 2010 (through personal secretary Ma Gopika), Nithyananda thanked her for all her service and wanted desperately to talk to her. Moreover, according to Nithyananda’s complaint against her in USA - she was not just a volunteer in the mission, she was trained and selected to teach meditation, yoga, conduct satsangs as an organizer in USA and even travelled with Nithyananda!

Aarthi has enough photo, email and other evidences to prove she was a closely connected and hence Nithyananda’s allegations are false. Please see one example email attached.

· Allegation: To avoid facing such a (money) judgment Aarthi Rao filed for bankruptcy, but court dismissed it for failure to appear

Fact: NOT TRUE. Aarthi Rao was forced to file for insolvency (bankruptcy) only because she has absolutely no money, she lost nearly 30 lakhs ($60,000) in just 6 months of fighting the false case. Only due to threat to her personal safety, she could not attend the hearing in person.

· Allegation: She is avoiding deposition when US court offered security

Fact: FALSE. The judge said very clearly Aarthi was not avoiding deposition since she was willing to appear by phone due to safety concerns. Unfortunately, the court granted security only within the court premises, but the threat to her safety is outside the court. Because of such serious concerns about her physical safety from Nithyananda’s henchmen who are desperate to silence her (as Ma Gopika, Nithyananda’s personal secretary, has been silenced for last 2 years), she has been unable to physically attend deposition.

· Allegation: She has given same complaint to USA police, which they have investigated and closed as false

Fact: LIE. She has given complaints to more than 5 agencies in USA, including police, prosecutors and FBI. Most are still investigating her complaint (please see evidence attached). Only 1 prosecutor informed her that the matter must be reported to the police for investigation (which she already did). Further he added that since the accused (Nithyananda) is not in USA and because the accused is already being prosecuted for similar charges in India, it is unlikely that the prosecutor’s office will pursue the complaint. Clearly, the complaint was not closed as false, as misrepresented by Nithyananda.

· Allegation: She is facing serious charges in USA for child abuse.

Fact: Absolutely shocking!! She has no knowledge of such a complaint as she has not been contacted by any US police in this regard (although the same police has her contact information from her own complaint). This must be one more false complaint filed to harass and intimidate her into silence.

Similar false case has been used to arrest victim Vinay Bharadwaj when he was talking to KA CID. In the (false) civil complaint filed against her, Nithyananda’s organization 1st claimed she molested some children, and later amended it to molesting some unknown woman. US lawyers were surprised and puzzled to see such unrelated criminal allegations in a civil complaint. But to Aarthi it was a clear threat that she will face some kind of molestation case and suffer the same fate as Vinay Bharadwaj, if she continued to speak out against Nithyananda.

Nithyananda, using his supporters, is clearly misusing the court systems both in India and in USA to harass, intimidate and also to bring down her credibility as a key prosecution witness in the criminal trial in India. These are clear examples of brutal witness intimidation (through his clever manipulations).

Nithyananda’s ex-disciple rubbishes his claims

Published: Saturday, Jun 23, 2012, 12:45 IST
By DNA Correspondent | Place: Bangalore
Through a CD, Nithyananda’s former disciple Arathi Rao has denied the allegations the swami has levelled against her. She said he is spreading rumours about her.
As Arathi has gone into a hiding, her father Sethumadhav Rao held a press conference in the city on Friday and distributed the CD containing her message. In her message, Arathi has stated that she is not suffering from herpes 2—a sexually transmitted disease—and Nithyananda was spreading such rumours only to keep her quiet. She said she was willing to undergo a medical test.
She said she cannot step out as there is a threat to her life from Nithyananda. Nevertheless, she said, she would not be cowed down and fight till her last breath.
Her father said Nithyananda has accused her of blackmailing him (that she would make public an “explosive” CD of his) and making a huge amount of money by disseminating his techniques through her private yoga classes.
Veena of Spandana, an NGO that is supporting Arathi, said the organisation would soon file a PIL in the high court regarding huge donations that Nithyananda had been receiving for his offshore ashrams. Further, she said an American newspaper had reported about the swami’s links with Sri Lanka’s banned militant outfit, LTTE. She said all these angles should be investigated.

Madurai: The Tamil Nadu police have registered a case against controversial self-proclaimed godman Nithyananda and two others for providing devotees 'holy' water allegedly mixed with drugs at the Madurai Adheenam, the oldest religious centre in South India.

When the case came up for hearing before a Madras High Court bench today, the government advocate said police had registered a case under relevant sections against Nithyanandha and two others on a complaint by petitioner M Solaikannan of the Hindu Makkal Katchi.

Mr Solaikannnan said he had filed the petition as police had not acted on his complaint to test the nature of the water given to the devotees and to take necessary action.

The self-proclaimed godman had shifted base to Madurai recently after his Bangalore ashram was sealed earlier this month.

He first ran into trouble in 2010 when a sex tape allegedly of him with an actress aired on local channels. He was arrested on charges that include unnatural sex and was later given bail. More recently, an American woman said he had sexually exploited her for several years at his ashram.

Meanwhile, security has been tightened around the near 1500-year-old Madurai Adheenam following a bomb threat.

Police said the letter, written in Tamil, was received by the authorities at the religious centre on Thursday and it threatened that a bomb would go off on June 27.

The authorities handed over the letter, signed by one Parisutham, to the police.

He surrendered even as police conducted searches at his Bidadi ashram

In an unexpected development on Wednesday afternoon, the Ramanagaram police arrested self-styled godman Nithyananda when he appeared in the Ramanagaram Judicial Magistrate First Class court even as the police continued searches at his ashram in Bidadi, near here.
The police arrested him after the Judge, Komala, instructed him to come to the court on Thursday as procedures had to be observed. Since a search warrant had been issued against the accused, the police arrested him following directions from the court.
A team led by Ramanagaram Superintendent of Police Anupam Agarwal arrested the godman on the charge of assaulting a journalist and took him to an undisclosed place under tight police security for further investigation. Mr. Agarwal said that Nithyananda had come to the court to surrender.
‘Searches will continue’
Even though the godman was arrested, the police continued to search Nithyananda Dhyanapeetam. “We may have arrested the accused, but we cannot suspend the search operation until we receive an order from the Karnataka government,” a top official of the district administration told The Hindu.
Earlier, Nithyananda, who was believed to have taken shelter in Tamil Nadu, arrived in a Kerala State-registered car.
In Bangalore, Vishwa Hindu Parishad Bangalore unit president Vijay Kumar Reddy alleged that there was a conspiracy behind allegations of sexual harassment against Nithyananda and said unseen hands were working against him. He, however, failed to answer a number of queries posed to him on the activities of Nithyananda.
Meanwhile, the Karnataka High Court on Wednesday asked the State government to file its response, without being guided by media reports, to petitions filed by Nithyananda seeking quashing of the First Information Report registered against him in connection with the incident that occurred at his ashram in Bidadi.
Justice Subash B. Adi made these oral observations during hearing of the petitions when the prosecution sought time to file its response to Nithyananda's petition. Further, hearing on the petition has been adjourned till Friday.
The Kamraj National Congress has urged Karnataka Chief Minister D.V. Sadananda Gowda to review the government's action against Nithyananda.
In a press release, party president M.S. Rajendran has questioned the government's right to indulge in such acts and has said that human rights groups will not tolerate the manner in which the inmates of the ashram were driven out.

Nithyananda re-arrested, sent to one-day judicial custody l

PTI  Ramanagar (Karna), June 14, 2012 | UPDATED 01:07 IST

Just hours after being granted bail by a court in Ramanagar, controversial self-styled godman Nithyananda was re-arrested on Thursday and remanded to one-day judicial custody on charges of disturbing the peace.
Nithyananda, arrested on Wednesday after he appeared before a court to surrender in an assault case, was slapped with a fresh case of disturbing the peace in Ramanagara and surrounding areas of Nithyananda Ashram at Bidadi near Ramanagar.
He was arrested under different IPC Sections, including 151 (relating to disturbance of the public peace) and sent to one-day judicial custody, Ramanagara Superintendent of Police Anupam Agarwal said.
Agarwal said Nithyananda would be taken to Mysore Central Prison to avoid any untoward incidents and added that the case would be heard tomorrow and the Deputy Commissioner would take a further decision in the matter.
"Nithyananda has been exempted from personally attending the court. However, his lawyer will appear for him tomorrow," Agarwal said.
Earlier in the day, Ramanagara Judicial First Class Magistrate Komala granted bail to Nithyananda subject to him furnishing one surety and a personal bond of Rs.50,000.
Public Prosecutor K Mohan Kumar said bail had been granted to Nithyananda since assault and life threat case against him were bailable.
The self-styled godman, already facing criminal charges, including rape and out on bail after his arrest in 2010, courted fresh trouble when police on June 8 booked him and his followers for allegedly assaulting a mediaperson at a press conference at his ashram at nearby Bidadi.
Even as he faced the police action, Nithyananda filed a writ petition in the High Court seeking Rs.10 crore as damages to his ashram property from the state government.
Chief Minister D V Sadananda, Ramanagar District Deputy Commissioner and others have been named in the petition.

Sex Swami' Nithyananda arrested in Himachal

'Sex Swami' Nithyananda arrested in Himachal Solan, Himachal Pradesh: Bangalore's "Sex Swami" Nityanand has been arrested a long way from home - in Himachal Pradesh's Solan district. Nityanand was arrested in Arki by the Bangalore Police, who had sought the help of the Himachal Police. Police said at the time of arrest, the swami had Rs. 3 lakh in Indian currency and 2000 dollars in travellers' cheques. (Read: Swamis in scandals - What keeps the faith?) The self-styled swami would be produced before a local magistrate in Himachal Pradesh and then would be taken to Bangalore. The controversial swami has been at large ever since television channels aired video clippings purportedly of him and a Tamil actress in a compromising situation. (Read: Swami's alleged sex CD sells for Rs. 1,000) Cases of rape, criminal intimidation and cheating among others have since been filed against the Godman based on various complaints. His ashram had been searched and hard disks seized were being examined, the police said. On allegations of rape against the swami, they appealed to victims to come out and give evidence. The swami's ashram has maintained that there is a "conspiracy" to malign Nityananda's reputation and have said that the video footage telecast by TV channels was morphed. After the sex tape surfaced, Nityananda's supporters issued this statement: "At this moment we feel that a mix of conspiracy, graphics and rumour are at play in these recent events that have unfolded. We are working on a legal course of action...In these trying times, we wish to reassure the lakhs of devotees and well-wishers whose sentiments have been deeply hurt by this conspiracy. We thank all the devotees and disciples for standing with us during these trying times." Nityananda had recently announced that he was quitting as the head of his ashram in Karnataka and associated trusts to lead a life of 'spiritual seclusion'. Nithyananda's Ashram is about 19 kilometres outside Bangalore, where he was based and was attacked by an angry crowd. He allegedly has 11 different ashrams in India, and close to 2 million followers all over the world. (Read: Sex Swami has property worth crores?)

Condoms, drugs and secret contracts... the story of why Nithyananda is in trouble

Bangalore, June 13, 2012 | UPDATED 10:15 IST

Controversial self-styled godman Nithyananda Paramahamsa, who went missing for five days after fresh charges of rape and confinement were levelled against him, was sent to jail for a day by a local court in Ramanagara, about 30 km from Bangalore on Wednesday.
The tainted guru, who had gone into hiding, prompting the Karnataka police to launch a massive manhunt to trace him, surrendered before the Ramanagara district court judge on Wednesday afternoon. Judge Komala remanded him to judicial custody for a day directing him to appear before the court on Thursday to hear his bail plea.
On Tuesday, the police evicted the occupants of Nithyananda's ashram in Bidari on Bangalore's outskirts and searched the premises. They were horrified to find a dump of condoms and ganja in the corner of a compound. The police sealed the ashram for further investigation.
A team of the police had gone to Madurai in Tamil Nadu to search for Nithyananda as he was recently anointed as the 293rd pontiff of the Adheenam Mutt.
On Tuesday, Karnataka Chief Minister D V Sadananda Gowda ordered the arrest of Nithyananda after several of his followers appeared on a private Kannada TV channel and accused the godman of exploiting them.
Arathi Rao, a follower of Nithyananda, gave a detailed account of her five-year experience with the guru. She alleged that Nithyananda repeatedly raped her and threatened her with dire consequences if she revealed it to anybody. Arathi also claimed that it was she who had secretly filmed Nithyananda's sex tapes with a Tamil actress.
Though Arathi had not lodged any formal complaint with the police fearing repercussions, it was sufficient for the government to order a probe against Nithyananda. Initially, his followers tried to bravely defend Nithyananda by accusing Arathi of carrying out a slanderous campaign against their guru.
Things went out of control when the followers of Nithyananda evicted the journalist of the Kannada TV channel, which aired Arathi Rao's interview, from the ashrama and allegedly beat him up.
The attack on the media prompted several Kannada organisations to vandalise Nithyananda's ashram. The police registered an FIR against Nithyananda and his followers on the basis of a complaint lodged by the media.
Nithyananda had approached the high court seeking to quash the FIR filed against him. The court has adjourned hearing into the matter to Friday.
This is the second time that Nithyananda had gone into hiding. After the sex tapes went public in April last year, Nithyananda had moved into a secret location in Himachal Pradesh from where he was apprehended. At present, the Karnataka police CID is probing the old cases against Nithyananda.
Last year, public mounted pressure on the government after it was revealed that Nithyananda had forced some of his followers to sign a non-disclosure agreement to experiment with tantric sex.
"The volunteer understands that the programme may involve the learning and practice of ancient tantric secrets associated with male and female ecstasy, including the use of sexual energy for increased intimacy/spiritual connection, pleasure, harmony and freedom," said one of the clauses in the agreement.
This created furore as it was alleged that the guru was exploiting women by making them sign the contract. The CID is probing those charges as well.

Where is Swamy Nithyananda?

Nithyananda faces prospect of arrest
12 Jun 2012, 0833 hrs IST, AGENCIES
Controversial self-styled godman Nithyananda faced a search warrant for his arrest after the government bearing the heat of public outrage decided to act against him over his activities including alleged sexual exploitation of his disciples.

Nithyananda, already facing criminal cases including rape on complaints from some former disciples last year, is reportedly absconding from his ashram at Bidadi in Ramanagara district near Bangalore.

With several protests on and calls for action against Nithyananda after a former US-based woman disciple narrated story of her alleged sexual abuse on a Kannada TV channel, Chief Minister D V Sadananda Gowda yesterday held a high-level meeting with top police officials and said he would be arrested in two days.

The meeting attended by DGP Lalrokhuma Pachau and other senior officials, also discussed the clash that took place between the media and his followers at his ashram last week, that has added to his troubles.

Gowda said he has asked the Deputy Commissioner and the Superintendent of Police to secure custody of Nithyananda's Dhyanapeetham premises and collect evidence about its activities and seal the ashram.

The government would hold discussions with the law department to seek cancellation of bail granted by the
Karnataka High Court to the self-styled godman in connection with a case of rape and criminal intimidation.

Nithyananda is facing criminal charges, including rape, after a slew of complaints were filed against him in 2010
after some local TV channels telecast purported videos of the self-styled godman in a compromising position with an actress.

Nithyananda, was arrested and later released on bail. Amid the developments, District in-charge Minister C P Yogeshwar visited the ashram area today, SP Anupam Agarwal said.

Meanwhile, protests against Nithyananda were held in several places across the state.

In the city, journalists staged a protest demanding action against those involved in the alleged assault of a TV reporter, shouting slogans against Nithyananda. The agitators, who burnt an effigy of Nithyananda, also demanded a thorough probe into the various sexual assault cases that have been filed against him so far.

Similar protests by pro-Kannada organisations were held in Davanagere, Mysore and Bellary. In Bellary, agitators burnt an effigy of Nithyananda and submitted a memorandum to District Commissioner Amlan Biswas.

Agarwal said police were investigating into the altercation and appropriate action would be taken against those found guilty.

He said the whereabouts of Nithyananda was not known yet.

The SP said Yogeshwar had directed him to submit a detailed report on the June 7 incident to Deputy Commissioner Sriram Reddy. Facing the heat, Nithyananda in a message to his followers said he was not on the run and 'touring places.'

"I heard about the problems caused in the Bidadi ashram by the anti-social elements, but thanks to the timely intervention of the Bidadi and Ramangara police, all matters are under control," he said.

Nithyananda said none can stop them from doing "good spiritual and social work" and all his charitable work,
including 'Annadaanam' (free meals) would continue.

Protests against the self-styled godman were held in Mysore and Davangere also.

Police today issued a search warrant for the arrest of controversial godman Nithyananda, who is reportedly absconding from his ashram at Bidadi in Ramanagara district.
Chief Minister D. V. Sadananda Gowda told reporters after a high-level meeting with top police officials that Nithyananda would be arrested in two days. The meeting was called to discuss the clash that took place between the media and Nithyananda’s followers at his ashram last week. DGP Lalrokhuma Pachau attended the meeting.
The Chief Minister said that he has directed Regional Commissioner Shambhu Dayal Meena to submit a report to the government on the incident and also asked the District Collector and the Superintendent of Police to secure the custody of the Dhyanapeetham premises, collect evidence about its activities and seal the ashram.
The government would hold discussions with the law department to seek cancellation of bail of the self-styled godman, who was granted bail by the Karnataka High Court in connection with a case of rape and criminal intimidation.
Nithyananda is facing criminal charges, including rape, on complaints from some former disciples last year. He was arrested and later released on bail.
On June 8, police had lodged criminal cases against him and his followers for allegedly assaulting a mediaperson during a press conference at his Ashram.
The FIR was filed on complaints from a regional TV channel reporter and activists of Nava Nirmana Sene in connection with an altercation at the ashram the previous night.
On a counter complaint by two followers of Nithyananda, police also registered two FIRs against the reporter and Sene activists for alleged outrage of modesty, physical assault and threat to life.
The reporter alleged he was assaulted and threatened after he asked a question at a press meet convened by the godman in the backdrop of charges of sexual abuse levelled against him by a U.S.-based woman.

Demand to ostracise Nithyananda from Karnataka

Bangalore: Pro-Kannada organisations along with Swami Yogeshwar Rishi Kumar of Kali Mutt took out a rally from the Koti Anjaneya Temple to Nithyananda Swami Dhyanapeetam Ashram in Bidadi on Sunday, condemning the roughing up of media personnel by followers of self-styled godman Swami Nithyananda.
Over 3,000 protesters took out a padayatra holding placards and banners condemning the actions of “Nithya Bhaktas”. The rally halted at some distance from the ashram as the Ramanagaram police had provided bandobast and had clamped down prohibitory orders there, where they sat on a dharna.
Later, the protesters handed over letters containing their demands to tahsildar Ravikalnahalli. The agitators also demanded that posters of the controversial godman be removed in the highway stretch along Bidadi, which the tahsildar ordered.
Demand to ostracise Nithyananda from Karnataka
Speaking at the protest, Swami Yogeshwar Rishi Kumar said, “I have demanded officials to ostracise Swami Nithyananda and seal his ashram. Also, the arrested Kannada activists must be released and the ashram inmates must be jailed.” He added that he and seer of Kolaka Mutt will go on an indefinite hunger protest on June 14 if their demands are not met.
Outfits such as the Karnataka Suvarna Sene, Spandana Women Rights Organisation and Karnataka Nava Nirmana Sene will participate in the protest.
Earlier, Nithyananda allegedly disappeared from the ashram when inmates of his ashram roughed up media personnel. A scribe had filed a complaint against the godman and his disciples. Police detained a total of 35 persons and imposed section 144 of the IPC. While a few persons were let off, others are still in jail. Reacting to the reports, his official blog said that he was in Madurai and that he will return to offer pooja, in addition to holding a press conference.

Nithyananda ashram to be sealed, chief minister wants him arrested

Reported by Maya Sharma with PTI inputs | Updated: June 11, 2012

Bangalore: There is more trouble for controversial godman Nithyananda. Following clashes between Kannada activists and Nithyananda's followers on Friday, the state government has decided to seal his ashram in Bidadi outside Bangalore.

The clashes broke out after recent allegations by a US-based woman that she was sexually abused by Nithyananda for five years, a charge denied by him.

A tape allegedly featuring Nithyananda and an actress had surfaced in 2010 - and the godman had been arrested and released on bail on charges including unnatural sex. Karnataka Chief Minister Sadananda Gowda says the bail should be cancelled and Nithyananda should be arrested.

Earlier, police had registered two cases against the godman and others in connection with an altercation between his followers and a section of media during a press conference at his ashram on June 7.

District in-charge Minister CP Yogeshwar visited the ashram area on Saturday, Superintendent of Police Anupam Agarwal said.

Meanwhile, protests against Nithyananda were held by journalists in several places across the state on Saturday. The protesters demanded action against those involved in the alleged assault of a TV reporter, shouting slogans against Nithyananda.

Similar protests by pro-Kannada organisations were held in Davanagere, Mysore and Bellary.

In Bellary, agitators burnt an effigy of Nithyananda and submitted a memorandum to District Commissioner Amlan Biswas.

Mr Agarwal said police were investigating  and appropriate action would be taken against those found guilty.

He said the whereabouts of Nithyananda were not known.

Facing the heat, Nithyananda in a message to his followers said he was not on the run and was 'touring places.'

"I heard about the problems caused in the Bidadi ashram by the anti-social elements, but thanks to timely intervention of the Bidadi and Ramangara police, all matters are under control," he said.

Nithyananda said none can stop them from doing "good spiritual and social work" and all his charitable work, including 'Annadaanam' (free meals) would continue.
