ராம்நகர் நீதிமன்றத்தில் ஆஜரானா சாமியார் நித்யானந்தா!

புதுடெல்லி: உச்சநீதிமன்ற உத்தரவின்படி ராம்நகர் நீதிமன்றத்தில் சாமியார் நித்யானந்தா இன்று (18ஆம் தேதி) ஆஜரானார்.கர்நாடகாவில் ஆன்மீக ஆசிரமத்தை நடத்தி வந்த சாமியார் நித்யானந்தா, பல பெண்களை பாலியல் பலாத்காரம் செய்ததாக புகார் எழுந்தது. இதையடுத்து, கர்நாடக போலீசார் அவரை கைது செய்தனர். இதையடுத்து நித்யானந்தா ஜாமீனில் வெளியே வந்தார்.
இந்நிலையில், அவருக்கு ஆண்மை பரிசோதனை நடத்த பெங்களூரு காவல்துறையினர் முடிவு செய்தனர். இதையடுத்து, ஆண்மை பரிசோதனை நடத்துவதற்கு தடை விதிக்க வேண்டும் என பெங்களூரு உயர்நீதிமன்றத்தில் நித்யானந்தா சார்பில் மனு தாக்கல் செய்யப்பட்டது.
இந்த மனு மீதான விசாரணை பல வருடங்களாக நடைபெற்று வந்த நிலையில், கடந்த மாதம் 16ஆம் தேதி, காவல்துறையினர் தங்களது கட்டுப்பாட்டில் வைத்து நித்யானந்தாவுக்கு ஆண்மை பரிசோதனை நடத்தலாம் என உத்தரவிட்டது. ஆனால், ஆண்மை பரிசோதனைக்கு நித்யானந்தா ஆஜராகாததால், அவரை கைது செய்து ஆஜர்படுத்த கடந்த மாதம் 28ஆம் தேதி ராம்நகர் நீதிமன்றம் உத்தரவிட்டது.
இதைத் தொடர்ந்து நித்யானந்தா சார்பில், ஆண்மை பரிசோதனைக்கு தடைவிதிக்கக்கோரி பெங்களூரு உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்யப்பட்டது. இந்த மனுவை விசாரித்த நீதிபதி, நித்யானந்தாவின் மனுவை நிராகரித்ததோடு, அவருக்கு 6ஆம் தேதி ஆண்மை பரிசோதனை நடத்த வேண்டும் என்றும், 7ஆம் தேதி அவரை ராம்நகர் நீதிமன்றத்தில் ஆஜர்படுத்த வேண்டும் என்றும் உத்தரவிட்டார்.
இந்த உத்தரவை எதிர்த்து நித்யானந்தா சார்பில் உச்சநீதிமன்றத்தில் மேல்முறையீடு செய்யப்பட்டது. இதை விசாரித்த நீதிபதி, நித்யானந்தாவிற்கு ஆண்மை பரிசோதனை செய்ய இடைக்கால தடை விதித்ததோடு, இந்த வழக்கின் அடுத்தக்கட்ட விசாரணையை 12ஆம் தேதிக்கு ஒத்திவைத்தார். மேலும், 18ஆம் தேதி ராம்நகர் நீதிமன்றத்தில் ஆஜராகவும் நித்யானந்தாவுக்கு உத்தரவிட்டார்.
இந்த நிலையில், உச்சநீதிமன்றத்தின் உத்தரவுப்படி இன்று (18ஆம் தேதி) ராம்நகர் நீதிமன்றத்தில் நித்யானந்தா நேரில் ஆஜரானார். அவருடன் சீடர்களும் வந்திருந்தனர். அதைத்தொடர்ந்து இந்த வழக்கு விசாரணையை வருகிற 23ஆம் தேதிக்கு ஒத்தி வைத்து நீதிபதி உத்தரவிட்டார். நித்யானந்தா ஆஜரானதையொட்டி ராம்நகர் நீதிமன்றத்தில் பலத்த பாதுகாப்பு போடப்பட்டு இருந்தது.
இந்த மனு மீதான விசாரணை பல வருடங்களாக நடைபெற்று வந்த நிலையில், கடந்த மாதம் 16ஆம் தேதி, காவல்துறையினர் தங்களது கட்டுப்பாட்டில் வைத்து நித்யானந்தாவுக்கு ஆண்மை பரிசோதனை நடத்தலாம் என உத்தரவிட்டது. ஆனால், ஆண்மை பரிசோதனைக்கு நித்யானந்தா ஆஜராகாததால், அவரை கைது செய்து ஆஜர்படுத்த கடந்த மாதம் 28ஆம் தேதி ராம்நகர் நீதிமன்றம் உத்தரவிட்டது.
இதைத் தொடர்ந்து நித்யானந்தா சார்பில், ஆண்மை பரிசோதனைக்கு தடைவிதிக்கக்கோரி பெங்களூரு உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்யப்பட்டது. இந்த மனுவை விசாரித்த நீதிபதி, நித்யானந்தாவின் மனுவை நிராகரித்ததோடு, அவருக்கு 6ஆம் தேதி ஆண்மை பரிசோதனை நடத்த வேண்டும் என்றும், 7ஆம் தேதி அவரை ராம்நகர் நீதிமன்றத்தில் ஆஜர்படுத்த வேண்டும் என்றும் உத்தரவிட்டார்.

ஆண்மை பரிசோதனை விவகாரம் நீதிமன்றத்தில் நித்யானந்தா ஆஜர்: அடுத்தகட்ட விசாரணை 23-ம் தேதிக்கு ஒத்திவைப்பு
ஆண்மை பரிசோதனை குறித்த மனு மீதான விசாரணையில் சாமியார் நித்தியானந்தா கர்நாடக மாநிலம் ராம் நகர் நீதிமன்றத்தில் திங்கள்கிழமை நேரில் ஆஜரானார்.
கடந்த 2011-ம் ஆண்டு நித்தியானந்தா மீது அவரது முன்னாள் பக்தை ஆர்த்தி ராவ் ராம் நகர் மாவட்ட போலீஸில் பாலியல் பலாத்கார புகார் அளித்தார். இவ்வழக்கில் அவர் கைது செய்யப்பட்டு மைசூர் சிறையில் அடைக்கப்பட்டார். நித்தியானந்தா மீது பாலியல் பலாத்கார வழக்கு பதிவாகியுள்ளதால் அவருக்கு ஆண்மை பரிசோதனை செய்ய முடிவெடுத்தனர். இதற்கு நித்தியானந்தா கடும் எதிர்ப்பு தெரிவித்தார்.
அதனைத் தொடர்ந்து, நித்தியானந்தாவுக்கு ஆண்மை பரிசோதனை நடத்த உத்தரவிடக் கோரி ராம் நகர் மாவட்ட அமர்வு நீதிமன்றத்தில் போலீஸார் மனு செய்தனர்.
இதனை எதிர்த்து கர்நாடக உயர் நீதிமன்றத்தில் நித்தியானந்தா மேல்முறையீடு செய்தார். இதை விசாரித்த நீதிமன்றம் கடந்த ஜூலை 16-ம் தேதி நித்தியானந்தாவுக்கு ஆண்மை பரிசோதனை நடத்த தடை விதிக்க முடியாது என உத்தரவிட்டது.
இதனிடையே, 'தனக்கு ஆண்மை பரிசோதனை நடத்த அனுமதிக்கக்கூடாது' என உச்ச நீதிமன்றத்தில் மேல்முறையீடு செய்தார். அம்மனுவை விசாரித்த உச்ச நீதிமன்றம் கர்நாடக உயர் நீதிமன்ற உத்தரவுக்கு இடைக்கால தடை விதித்தது.
குற்றவாளி கூண்டில்
இதனிடையே இந்த வழக்கு ராம் நகர் மாவட்ட அமர்வு நீதிமன்றத்தில் நீதிபதி ஹொசகவுடர் முன்னிலையில் திங்கள்கிழமை விசாரணைக்கு வந்தது. அப்போது நித்தியானந்தா நீதிமன்றத்தில் நேரில் ஆஜர் ஆனார். மேலும் இவ்வழக்கில் குற்றவாளிகளாக குற்றம்சாட்டப்பட்டுள்ள அவரது சீடர்கள் தனசேகர், கோபால்ரெட்டி ஷீலம், சிவ வல்லபா, ராகினி வல்லபனேனி ஆகியோரும் ஆஜர் ஆனார்கள். இவர்கள் 5 பேரும் நீதிமன்ற பணிகள் முடியும் வரை (40 நிமிடங்கள்) குற்றவாளி கூண்டில் நிற்க வைக்கப்பட்டனர்.
அப்போது நித்தியானந்தாவுக்கு ஆண்மை பரிசோதனை நடத்த உச்ச நீதிமன்றம் தடை விதித்துள்ளது பற்றி நீதிமன்றத்தில் தெரிவிக்கப்பட்டது. அதனைத் தொடர்ந்து நீதிபதி ஹொச கவுடர் வழக்கின் அடுத்தக்கட்ட விசாரணையை ஆகஸ்ட் 23-ம் தேதிக்கு ஒத்தி வைத்து உத்தரவிட்டார்.
நித்தியானந்தா மீது கன்னட அமைப்புகளும், பொது மக்களும் தாக்குதல் நடத்த திட்டமிட்டு இருப்பதாக தகவல் வெளியானதால், நீதிமன்ற வளாகத்தில் பலத்த பாதுகாப்பு ஏற்பாடுகள் செய்யப்பட்டிருந்தன. இருப்பினும் நீதிமன்றத்துக்கு வெளியே குழுமி இருந்த கன்னட அமைப்பினர் அவருக்கு எதிராக கோஷங்களை எழுப்பினர்.

Godman' had said he is neither man nor woman in his defence
The Karnataka government on Wednesday told the Supreme Court that it was necessary for self-styled godman Nityananda Swamy, accused of sexually exploiting his disciples, to undergo a medical examination to verify his claim of not having any desire as he was neither a man nor a woman.
In an affidavit, the Karnataka CID said it is up to the court to issue direction or grant permission to the police for carrying out further investigations, including medical examination, in view of Section 53A of the Criminal Procedure Code.
Forcing him to undergo a potency test would not be violative of his fundamental right as guaranteed under Article 20 (3) (no one can be compelled to stand witness against himself) of the Constitution, the police claimed. Swamy, who faces charges of rape and indulging in unnatural sex, was arrested on April 22, 2010. He was, however, granted bail on June 11, 2010. The 37-year-old has founded an ashram with its headquarters in Bangalore.
In an affidavit, the Karnataka CID said it is up to the court to issue direction or grant permission to the police for carrying out further investigations, including medical examination, in view of Section 53A of the Criminal Procedure Code.

Swamy approached the Supreme Court this month after the Karnataka High Court on July 16 refused to interfere with a trial court’s direction to undergo a medical test and give a voice sample.
The apex court stayed the potency test against him and asked the Karnataka Police to file their response on his plea. Explaining the need for Swamy to undergo the medical examination, the affidavit filed through advocate Joseph Aristotle, said, “The petitioner after being enlarged on bail, spoke to the media several times, stating that he is neither a woman nor a man. He does not have any sexual desire, he is just like a child, etc. By saying so, he tried to impress that he is not capable of performing sexual activities and has no sexual potentiality.”
The police also referred to the modus operandi of the petitioner under which he allegedly entered into confidential agreements, called non-disclosure agreements (NDA), with his disciples. “It is pertinent to state that the said NDAs that were fraudulently coerced to be executed by the victims contained terms that would infer the consent of the victims to satisfy his sexual needs under the guise of tantric practices,” the investigators alleged.
Justifying the requirement of his voice sample, the police stated it was a fully innocuous exercise as comparing the specimen with a seized audio CD would help them draw a conclusion in the cases.
The police claimed to be in possession of a CD having Swamy’s conversations with complainants, in which he purportedly confessed about his illegal sexual activities and unnatural offences, and justified his acts under the guise of spiritual practices and pleaded forgiveness. The Karnataka CID also contended that the matter against the accused has been pending for more than four years due to “various delaying tactics” adopted by him.

நித்யானந்தாவுக்கு ஆண்மை பரிசோதனை வழக்கு விசாரணை ஒத்திவைப்பு -நடிகை ரஞ்சிதா மனு தள்ளுபடி
பெங்களூர்: ஆண்மை பரிசோதனை நடத்த தடை கோரி நித்யானந்தா தாக்கல் செய்திருந்த மனு மீதான விசாரணையை உச்சநீதிமன்றம் வரும் 20ம் தேதிக்கு ஒத்திவைத்தது. கர்நாடக மாநிலம், ராம்நகரம் மாவட்டம், பிடதியில் உள்ள தியான பீட ஆசிரமத்தின் மடாதிபதி நித்யானந்தா மீது கர்நாடகாவில் பல வழக்குகள் பதிவாகியுள்ளன. போலீஸ் தரப்பு கோரியதை ஏற்ற ராம்நகரம் மாவட்ட அமர்வு நீதிமன்றம் நித்யானந்தாவுக்கு ஆண்மை பரிசோதனை செய்ய அனுமதி அளித்தது. இதை எதிர்த்து தாக்கல் செய்த மனுவை உயர் நீதிமன்றம் தள்ளுபடி செய்தது. அதையடுத்து ஆண்மை பரிசோதனைக்கு தடை கோரி நித்யானந்தா சார்பில் உச்ச நீதிமன்றத்தில் மேல்முறையீடு செய்யப்பட்டது.

புது டெல்லி, ஆக.14 - நித்யானந்தா வழக்கில் ஒரு வாரத்தில் பதில் மனு தாக்கல் செய் யும்படி கர்நாடக அரசுக்கு உச்ச நீதிமன்றம் உத்தரவிட்டுள்ளது.
நித்யானந்தா மீது கடந்த 2010-ஆம் ஆண்டு தொடரப்பட்ட பாலியல் பலாத்கார வழக்கில் அவருக்கு ஆண்மை பரிசோதனை நடத்தும்படி கர்நாடக நீதிமன்றம் உத்தரவிட்டிருந்தது. இந்த உத்தரவுக்கு இடைக்கால தடை விதித்த உச்ச நீதிமன்றம் கர்நாடக அரசு பதிலளிக்கவும் அவகாசம் அளித்திருந்தது.
இந்நிலையில் இந்த வழக்கு நீதிபதிகள் ரஞ்சனா பிரகாஷ் தேசாய், என்.வி.ரமணா அடங்கிய அமர்வு முன்பு விசாரணைக்கு வந்தது. கர்நாடக அரசு தரப்பில் கால அவகாசம் கோரினர். இதனால் கோபமடைந்த நீதிபதி கள், ‘ஒரு வழக்கில் பதில் மனு தாக்கல் செய்ய உங்களுக்கு ஒரு வாரம் அவகாசம் போதாதா? நித்யானந்தா தொடர்பாக இன் னொரு வழக்கு இதே நீதி மன்றத்தில் நிலுவையில் உள்ளது. அதை நீங்கள் இரு தரப்புமே எங்களுக்கு தெரிவிக்க வில்லை. வழக்கு இங்கு நிலுவை யில் இருப்பதை மறைத்து உத்தரவு பெறுவது தவறு. ‘4 ஆண்டுகளாக ஒரு குற்ற வழக்கில் எந்த நட வடிக்கையும் எடுக்கப்படாமல் நிலுவையில் வைக்கப்பட்டுள்ளது. உங்கள் நடவடிக்கையில் எங் களுக்கு கொஞ்சம்கூட திருப்தி யில்லை’ என்றும் நீதிபதிகள் குறிப் பிட்டனர்.
அதற்கு கர்நாடக அரசு தரப்பு வழக்கறிஞர் வருத்தம் தெரிவித்தார். இதையடுத்து கர்நாடக அரசு பதில் மனு தாக்கல் செய்ய ஒரு வாரம் அவகாசம் அளிக்கப்பட்டது.

தாம் இன்னமும் மதுரை இளம் ஆதீனமாகவே நீடிப்பதாக, நித்தியானந்தா மதுரை நீதிமன்றத்தில் மனுத் தாக்கல் செய்துள்ளார்.

SC pulls up petitioners for 'non-cooperation' with investigating agency
The Supreme Court on Tuesday stayed the Karnataka High Court order directing Nithyananda to appear for a potency test on August 6 at Victoria Hospital in connection with a four-year-old rape case.
A bench of Justices Ranjana Prakash Desai and N V Ramana asked the Karnataka government to respond to a special leave petition filed by him and other accused challenging the high court order refusing to quash the case against them.
The apex court, however, pulled up the petitioners for their “non-cooperation” with the investigating agency as the public prosecutor contended the accused had shown little effort in helping to finish the pending matters.

“We want to clarify and our anxiety is also that whatever is the case and whosoever is the accused, all investigations must be done without any delay. We are conveying this to you (petitioners) that no efforts should be made to stall the proceedings. Things must progress and everything must be done in an appropriate manner,” the bench said, reminding the counsel that the case was of 2010 and it was now 2014.
Senior advocate Mohan Parasaran, appearing for the petitioner, contended that the high court had passed the order on July 16 without giving them an opportunity of hearing, in violation of the principle of natural justice.
He claimed that the high court dismissed a plea for quashing of the criminal case on a motion moved by the public prosecutor.
An adjournment sought on medical ground by the petitioners counsel was denied and the matter was preponed from August 28, another petition filed by advocate Nishanth Patil on behalf of accused Dhanashekaran and others, said.
The counsel, representing the victim, submitted that the petitioners had themselves given an undertaking before the court that they would appear before the Ramanagara court on August 18. He also questioned the anxiety shown by the petitioner against undergoing medical test

He claimed that the high court dismissed a plea for quashing of the criminal case on a motion moved by the public prosecutor.
An adjournment sought on medical ground by the petitioners counsel was denied and the matter was preponed from August 28, another petition filed by advocate Nishanth Patil on behalf of accused Dhanashekaran and others, said.
The counsel, representing the victim, submitted that the petitioners had themselves given an undertaking before the court that they would appear before the Ramanagara court on August 18. He also questioned the anxiety shown by the petitioner against undergoing medical test
