Tamil Nadu News Magazine in its issue dated 29-7-12 has explained about the Nithyananda case in U.S.Court. In a petition filed by Popatlal Salva at the California Court in USA, the court has given a judgment against Nithyananda Foundation and has termed it a fraud foundation.

In its judgment dated 19th july U.S.Court says Nithyananda Foundation must return the amount of 8.5 crores which was received from Popatlal Salva. Moreover Nithyananda foundation should return the expense amount which Salva incurred in this case that will also amount to several crores.

Some of the devotees of Nithi told that Nithi is not having favourable time now. There are also several cases pending against him with Karnataka CID police and others. So at present Nithyananda is thinking of going to Kailash Mountain on July 27th and from their he may go to Nepal to stay their permanently to avoid in getting complications in India. In the name of Jeevan Mukthi Nithyananda has spoiled the carriers of several educated girls in India.

The people of Tamil Nadu will feel happy if Nithyananda goes to Nepal and stay their permanently.

Kailash-bound Nithya may skip potency test

Swami Nithyananda is at it again. He is now trying to avoid the potency test despite a court order directing him to undergo the same on July 30. He has filed a petition in the Ramanagaram court expressing his inability to subject himself to the test and sought a fresh date.   In his petition, Nithyananda has said he is travelling to Kailash Manas Sarovar on the day. CID authorities have decided to file an objection. A CID officer told Bangalore Mirror it’s a ploy employed by him (Nithyananda) to skip the test.   “The CID will be filing its objections in the court in a day or two asking the court not to consider alternative dates,” said an official.   The court hearing Nithyananda’s case had recently given CID the go-ahead for carrying out medical and voice tests on him after the investigating agency said they were crucial for investigations and that Nithyananda had been avoiding them despite repeated notices.   Victoria Hospital top-brass had been asked to set up a medical board to conduct medical and voice tests and set a date for conducting them. A team of five doctors was formed and July 30 fixed as the date. Experts, however, said Nithyananda can move higher courts if the CID’s plea prevails in the Ramanagaram court. “He can move the High Court or Supreme Court. If the grounds are genuine, then he will get relaxation,” said a legal expert. Senior pontiff unhappy with Nithyananda's disciples

The head of the ancient Saivite Mutt here, Sri La Sri Arunagirinathar, has reportedly rejected junior pontiff Nithyananda's invitation for the proposed 'Kailash Yatra' on July 27, sources close to him said today.
Speaking to newsmen on the condition of anonymity, they said the senior pontiff was not happy with three disciples of Nithyananda removing portraits of the earlier Mutt heads, including his own portrait, from the mutt premises.
He was also unhappy with the three disciples interfering with property issues of the Madurai Adheenam (mutt),and asking some occupants of mutt properties to vacate, the sources said.
He had also asked Nithyananda to explain why he had not been informed about a Karnataka police summons to him 'for a masculinity test',they said.
Karnataka CB-CID Assistant Inspector Chandrasekharan had delivered the summons to a disciple of Nithyananda today.
Nithyananda is camping at Kodaikanal where he has been giving religious discourses for the past three weeks.
Various fora had objected to Nithyananda's appointment as the 293rd pontiff of the over 1500-year-old Madurai Adheenam by Arunagirinathar.
The self-styled godman is facing a CID probe into allegations of rape and criminal intimidation levelled against him in 2010 after some TV channels telecast purported video footage of him in a compromising position with an actress.
Out on bail after his arrest in 2010, he had courted fresh trouble on June 8 when police booked him and his followers for allegedly assaulting a mediaperson during a press meet at his ashram at nearby Bidadi.
The press conference was held in the backdrop of a US-based woman alleging that he had sexually abused her for five years.
Nithyananda was granted bail on June 15, a day after his re-arrest on charges of disturbing peace and lodged in Mysore Central Prison.

அமெரிக்காவில் வேத பல்கலைக்கழகம் தொடங்க நித்யானந்தா அறக்கட்டளை நிதி வசூல் செய்து வந்தது. இந்நிலையில் பாபட்லால் சாவ்லா என்பவர் நித்யானந்தாவுக்கு எதிராக கலிபோர்னியா மாவட்ட நீதிமன்றத்தில் வழக்கு தொடர்ந்திருந்தார்.

The Madras High Court today granted anticipatory bail to a former inmate of Swami Nithyananda’s Ashram, who feared arrest in a case for alleged offences, including cheating and criminal intimidation. Petitioner Arathi Rao said she feared arrest in the case which had been registered in 2011. The charge against her was that she surreptitiously took a video of the controversial godman with an actress and blackmailed him. Granting her bail, Justice MM Sundresh said she should execute a bond for Rs10,000 and furnish two sureties for a like sum to satisfaction of the XI Metropolitan Magistrate. She has also been told to deposit her passport with police and not leave the country without the court’s permission. Court in USA says Nithyananda foundation is guilty of fraud

Jury confirmed a FRAUD verdict against Nithyananda Foundation and Gopal Sheelum Reddy that they intentionally defrauded Mr. Popatlal Savla, the victim. The Jury awarded damages of 1.565 million dollars to be returned to Mr. Savla but on July 19 did not add punitive damages. In the course of proceedings, the Judge preliminarily concluded that Swami Nithyananda was an agent of Nithyananda Foundation and the jury impliedly found that Swami was Nithyananda Foundation's agent, hence was fully engaged in activities of Nithyananda Foundation. 

 During the trial between June 26-29, one of the defendants Ma Nithya Sadhananda, also known as Jamuna Rani, who testified that she was Swami's first disciple, admitted under oath that on September 3, 2005 she signed a non-disclosure agreement (NDA) to protect the "leader" (i.e. Swami Nithyananda). The NDA she signed, said in part, 

"Volunteer acknowledges and understands that the "Learning from the Master" Program ("Program") conducted by the Foundation may involve Tantric Rituals and by reading and signing this document, Volunteer will have released and discharged the providers, owners and creators of this Program for any and all liability that might arise. 

Volunteer understands that the Program may involve the learning and practice of ancient tantric secrets associated with male and female ecstacy, including the use of sexual energy for increased intimacy/spiritual connection, pleasure, harmony and freedom. Volunteer understands that these activities could be physically and mentally challenging and may involve nudity, access to visual images, graphic visual depictions, and descriptions of nudity and sexual activity, close physical proximity and intimacy, verbal and written descriptions and audio sounds of a sexually oriented, and erotic nature, etc." 

 This was most interesting because Ma Sadhananda faces criminal charges in India regarding the NDAs, and here she was in the federal court in Los Angeles admitting that she had executed the NDAs. 

Mr. Savla still has remaining claims that Nithyananda Foundation was not and is not a non-profit foundation. It is anticipated that several other donors will join in the upcoming portion of Mr. Savla's case, and will seek over 1 million dollars in return of donations, as well as punitive damages for the FRAUD of Nithyananda Foundation and it's agents such as Siva Vallabhaneni and Gopal Sheelum Reddy. Finally in the last portion of the pending case, the judge will have to rule on Mr. Savla's claim that Nithyananda Foundation, Gopal and Siva and others engaged in unfair business practices, and will have to rule on Mr. Savla's demand for payment of all of his attorney's fees. Mr. Savla is already awarded all of his costs incurred in the case thus far based on the Jury's July 2nd Fraud verdict in his favor.
